The Department of Administration is hereby established.

Due to the increase in governmental responsibilities and Township business in recent years as well as the increased complexity of government due to statutory and regulatory laws, the Township Committee believes it would be in the best interest of Township government and the citizens of Upper Freehold Township that all activities of the Township Committee and the various departments be coordinated in order to provide more efficient, economical and practical government and that the citizens, taxpayers and various residents of Upper Freehold Township will be best served by the creation of the position of Township Administrator. The Township Committee further believes that such a position will directly assist the Township Committee in continuing to provide efficient and responsive government pursuant to law in the Township.

The office of Township Administrator is hereby created and established in and for the Township pursuant to the provisions of this section and the provisions of N.J.S.A. 40A:9-136, et seq.

The Township Administrator shall be appointed by the Township Committee. The term shall be at the pleasure of the Township Committee pursuant to law.

The Township Administrator shall receive such compensation as shall be fixed by the Salary Ordinance.

The Township Administrator may be removed by a 2/3 vote of the Township Committee. The Resolution of removal shall become effective three months after its adoption by the Township Committee. The Township Committee may provide that the Resolution shall have immediate effect; provided, however, that the Township Committee shall cause to be paid to the Township Administrator forthwith any unpaid balance of salary together with all accumulated leave and other entitlements and salary for the next three calendar months following adoption of the Resolution and as may be set forth in N.J.S.A. 40A:9-138.

a. 
The Township Administrator shall be selected by the Township Committee on the basis of administrative and technical qualifications with special consideration to training and experience in local government and a background and practical experience in business.
b. 
The Township Administrator need not be a resident of the Township.
c. 
The Business Administrator may hold one or more municipal positions while at the same time carrying out the duties and responsibilities of the Township Administrator.

a. 
The Township Administrator shall be the chief administrative officer of the Township and shall be responsible to the Township Committee for the proper and efficient administration of the business and administrative governmental operations of the Township and shall have just powers and perform such duties other than those required by law only as may be authorized by the action of the Township Committee.
b. 
The Township Administrator shall supervise and direct the administration of all departments, officers, employees and agents of the Township and shall issue regulations or directives necessary for that purpose unless otherwise provided by law, and as directed by the Township Committee. The provisions in this section are to be interpreted and considered based on the understanding that it is the intention of the Township Committee that any reference to personnel and employees is not intended to in any way affect the rights of personnel as may exist according to New Jersey law and/or affect the rights of the Township Committee to conduct Executive Sessions involving personnel matters under the Open Public Meetings Act and/or according to law.
c. 
The Township Administrator shall serve as the personnel officer of the Township and as such be responsible for conducting interviews and meetings with all prospective applicants for either employment or promotion and shall make recommendations to be considered and in its discretion acted upon by the Township Committee with regard to appointments, promotions and such other employment-related actions and matters as may be necessary, (As to laws involving personnel and the applicability of the Open Public Meetings Act, see Subsection b above.)
d. 
Assist and advise the Township Committee in the preparation of the Municipal Budget.
e. 
Investigate and report to the Township Committee information as to availability of financial and other aid programs from the Federal, State and County governments.
f. 
Attend all Executive, Special and Regular Meetings of the Township Committee and such other meetings as directed by the Township Committee.
g. 
Perform such other duties as may be specifically assigned by action of the Township Committee.

There is hereby established in the Township the position of Chief Financial Officer pursuant to the provisions of N.J.S.A. 40A:9-140.1 et seq. (Chapter 110, Laws of New Jersey 1988).

The person to be appointed to the position of Chief Financial Officer shall be a Certified Municipal Finance Officer as provided by law.

The Chief Financial Officer shall be appointed by the Township Committee for a term of four years from January 1 in the year of appointment until a successor has been appointed and has qualified. (N.J.S.A. 40A:9-140.10)

a. 
The Chief Financial Officer shall be:
1. 
The custodian of financial records of the Township.
2. 
Responsible for all accounting procedures.
3. 
Responsible for accounts payable.
4. 
Responsible for the preparation of the payroll.
5. 
Responsible for such other duties as are associated with the office and as are prescribed by the applicable statutes, regulations and ordinances.
b. 
The Chief Financial Officer shall:
1. 
Receive funds entrusted, received or under the control of any Township officer or employees or of any department and deposit all funds received by him or her in depositories authorized by the Township Committee by resolution.
2. 
Have custody of all investments and invested funds of the Township or in possession of the Township in a fiduciary capacity, except as otherwise provided by law, and keep such funds and all moneys of the Township not required for current operations safely invested or deposited in interest bearing accounts.
3. 
Have the safekeeping of all bonds and notes of the Township and the receipt and delivery of the Township bonds and notes for transfer, registration or exchange.
4. 
Keep a full account of all cash receipts and disbursements of the Township and at least once each month, or more if the Township Committee requires, furnish the Township Committee with a statement of all moneys received and expended by him or her.

The Chief Financial Officer shall receive such salary and compensation as shall be fixed by the Salary Ordinance of the Township and as may be paid according to law.

Notwithstanding the provisions of any other law to the contrary, any person who has served as a Municipal Financial Officer of the Township for five consecutive years and who is reappointed as the Township's Chief Financial Officer shall be granted tenure of office upon filing with the Township Clerk and with the Director of the Division of Local Government Services in the Department of Community Affairs a notification evidencing his compliance with this section.
b. 
Thereafter, the person shall continue to hold office during good behavior and efficiency, and shall not be removed therefrom except for just cause and then only after a public hearing upon a written complaint setting forth the charge or charges against him pursuant to N.J.S.A. 40A:9-140.9 or upon expiration or revocation of certification by the Director pursuant to N.J.S.A. 40A:9-140.12.

The Township Committee shall provide for the appointment of a Tax Assessor.

The Tax Assessor shall hold the Tax Assessor's Certificate provided for in N.J.S.A. 54:1-35.25, et seq. and shall have the duty of assessing property for the purpose of general taxation. Nothing in this section shall affect adversely the salary or tenure rights acquired pursuant to N.J.S.A. 54:1-35.31 or any other law. In accordance with the provisions of N.J.S.A. 54:3-16, the Assessor, when making assessments, shall be governed by directions by the Monmouth County Tax Administrator. These directions shall be pursuant to rules adopted by the Monmouth County Tax Board.

The Township Committee shall determine the amount of compensation for the Tax Assessor in the Salary Ordinance.

The Tax Assessor shall hold office for a term of four years. Vacancies other than due to expiration of term shall be filled by appointment for the unexpired term.

Pursuant to N.J.S.A. 40A:9-141, the Township Committee shall provide for the appointment of a Tax Collector.

No person shall be appointed or reappointed as Tax Collector unless that person shall hold a Tax Collector's Certificate issued pursuant to N.J.S.A. 40:9-145.3. A Tax Collector appointed pursuant to this section may obtain tenure pursuant to the provisions of N.J.S.A. 40A:9-144 or 40A:9-145. Any person who shall be reappointed Tax Collector subsequent to having received a Tax Collector's Certificate pursuant to N.J.S.A. 40A:9-144.3 and having served as Tax Collector or who has performed the duties of Tax Collector for not less than four consecutive years immediately prior to such reappointment shall have acquired tenure and shall hold his or her office during good behavior and efficiency and shall be removed only for good cause shown and after a proper hearing before the Director of the Division of Taxation or his designee in accordance with the provisions of N.J.S.A. 40A:9-145.8.

The Tax Collector shall hold office for a term of four years from January 1 next following his appointment. Vacancies other than due to the expiration of term shall be filled by appointment for the unexpired term.

The Township Committee of Upper Freehold Township hereby recognizes the Hope Fire Company No. 1 as the Fire Company presently providing volunteer fire services to Upper Freehold Township.

The Township Committee of Upper Freehold Township shall provide contributions for the maintenance and operation of a volunteer Fire Company serving Upper Freehold Township. The contributions shall be made according to law and as may be authorized and appropriated each year in accordance with the funds available as well as in the discretion of the Township Committee pursuant to the requested needs of the Hope Fire Company No. 1.

This section is being passed pursuant to N.J.S.A. 40A:14-67, and the Township Committee may make such contributions as may be authorized pursuant to law pursuant to such agreement as may be entered into and upon such terms and conditions as shall be deemed necessary by way of mutual agreement as called for in N.J.S.A. 40A:14-67 with the Borough of Allentown.

This chapter is conditioned upon a reciprocal ordinance being passed by the Borough of Allentown in accordance with N.J.S.A. 40A:14-67, as the Borough of Allentown and Upper Freehold Township are adjoining municipalities presently served by the Hope Fire Company No. 1.

Upper Freehold Township, by and through its Township Committee, specifically reserves the right to amend and/or revoke this section at any time as may be necessary and in its discretion in the future and/or amend and supplement same in its discretion.

Creation of Position of Firefighter/Driver. The position of Firefighter/Driver is hereby created and established in and for the Township of Upper Freehold.
b. 
Appointment; Term. The Firefighter/Driver shall be appointed by the Township Committee. The employee shall serve at the pleasure of the Township Committee.
c. 
Compensation. The Firefighter/Driver shall receive such compensation as deemed appropriate depending on qualifications of applicant and shall be set by Resolution of appointment by the Township Committee, contingent upon funds available within the current budget and within the range of the current Salary Ordinance of the Township of Upper Freehold.
d. 
Qualifications and Requirements. The Firefighter/Driver shall meet all the qualifications set by law for such a position. The applicant must be able to perform all the duties as set in the job description approved by the Township entitled "Firefighter/Driver."
e. 
Duties and Responsibilities. The Firefighter/Driver will perform all the duties as detailed in the job description entitled "Firefighter/Driver." Although the employee will be assigned to the Hope Fire Company No. 1 fire station as place of employment, the employee will enjoy all the benefits and responsibilities of any other Township employee as set by the Township Code and any personnel policy and procedure adopted or that may be adopted by the Township Committee of the Township of Upper Freehold. The employee is responsible to report to the Township Committee member designated as Liaison and the Business Administrator, as required of all other employees of the Township.

a. 
Creation of Position of Captain. The position of Captain of the Fire Department is hereby created and established in and for the Township of Upper Freehold.
b. 
Appointment; term. The Captain of the Fire Department shall be appointed by the Township Committee. There shall be only one Captain. The employee shall serve at the pleasure of the Township Committee.
c. 
Compensation. The Captain shall receive such compensation as deemed appropriate depending on the qualifications of the applicant and shall be set by resolution of appointment by the Township Committee, contingent upon funds available within the current budget and within the range of the current Salary Ordinance of the Township of Upper Freehold.

The position of Fire Superintendent is hereby established, under the direction of the Township Administrator. The Fire Superintendent shall have full supervision of the Township of Upper Freehold career firefighters. The Fire Superintendent shall manage all career Fire Department operations to ensure their timely, thorough, and cost-effective completion, and shall perform the following job tasks in the operation of this position.

The duties of the Fire Superintendent shall include:
a. 
Directs the daily work assignments of the Township Fire Department personnel and ensures the satisfactory completion thereof.
b. 
Writes memos and Standard Operation Guidelines (SOGs) with the assistance of the Hope Fire Company Chief to inform, instruct, or direct Fire Department activities.
c. 
Ensures all departmental, County, State, and Federal rules and regulations are followed at the fire scene.
d. 
Reviews Department training programs to ensure compliance with applicable regulations, and may assist in training of the fire personnel.
e. 
Responds to alarms as determined by need. May establish command of incident or assist in extinguishment, e.g., indicated in NJIMS system or upon request for incident commander.
f. 
Reviews and approves the final written form of Standard Operating Guidelines (SOGs) and departmental regulations with the assistance of the Hope Fire Company Chief.
g. 
Authorizes training courses for Department staff.
h. 
Authority to relieve or recommend disciplinary actions of Township career firefighters for violations of departmental, County, State, or Federal regulations.
i. 
Maintains work schedule, including the recommendation of overtime, for Township career firefighters. Approves time off requests and provides for per diem firefighter shift coverage.
j. 
Maintains inventory control of Township Fire Department assets.
k. 
Reviews all monthly reports (apparatus, drills, fuel, and equipment requests) to initiate appropriate follow-up.
l. 
Provides information on equipment that requires capital expenditures for budget consideration.
m. 
Ensures that all staff violations of Fire Department rules and regulations are documented.
n. 
Assists the Township Administrator in the development of the Township Fire Department budget and in formulating the Township's position in negotiating applicable collective bargaining negotiations agreements.
o. 
Provides equipment replacement recommendations and schedule for budget consideration.
p. 
Approves expenditures for both budgeted and non-budgeted items.
q. 
Revises and approves specification for new equipment working in conjunction with the Hope Fire Company Chief.
r. 
Reviews bid returns from potential vendors for compliance with specifications, and makes recommendations to the Township Administrator with the assistance of the Hope Fire Company Chief.
s. 
Ensures that discrepancies in background checks for prospective new fire firefighters are investigated.
t. 
With input from the Hope Fire Company Chief, ensures that all required PEOS/NFPA standard tests are completed, i.e. Hose, Ladder, Pump SCBA and Fire Extinguishers testing are completed and any discrepancies noted are repaired and reports filed.
u. 
Ensures all inspections ISO/PEOSHA are assisted and complete to ensure compliance standards.
v. 
Ensures all necessary medical reviews of Township career firefighters are scheduled and kept current.
w. 
Ensures that all firefighter training records are kept up to date, and all firefighters complete all necessary annual training, including new firefighter recruits.
x. 
Consults with and advises the Township Administrator with respect to any matters pertaining to Fire Department policy, personnel, or the purchase of equipment and supplies or other matters generally relating to the efficient operation of the Fire Department.
y. 
Ensures that firefighters' injuries are documented and reports are filed with the insurance company in a timely manner.
z. 
Develops recommendations for the protection of life and property in the Township.
aa. 
The Fire Superintendent shall maintain the following required State of New Jersey certifications for the position:
1. 
NJIMS 1-400 (Incident Management Level 3).
2. 
NJ Emergency Medical Technician-B.
3. 
NJ level 1 Fire Instructor.
4. 
NJ Firefighter 2 Certification.
5. 
Smokehouse Instructor (Drill Ground Instructor).
6. 
Pump Operations.
7. 
Hazardous Material Operation.
8. 
Extrication Certified (Vehicle Rescue).
bb. 
The title of this position shall be established as Fire Superintendent which will avoid any conflicts with positions of the present career firefighters and volunteer officers established, at the present time, in the Township of Upper Freehold and in the Hope Fire Company where the title of Fire Chief will still be retained to follow normal protocols as per State guidelines on firematics incidents.
cc. 
Directs the regular inspection of apparatus and gear and provides recommendations for maintenance.
dd. 
Meets regularly, as necessary, with the Hope Fire Company Chief, Deputy Chief and/or Assistant Chief.
