As used in this chapter:
FOOD ESTABLISHMENT CODE
Shall mean Chapter 12 of the New Jersey State Sanitary Code,
Sanitation in Retail Food Establishments and Food and Beverage Vending
Machines (1993) approved by the State Department of Health being a
code regulating food establishments and food and beverage vending
machines and providing for its enforcement.

a. No person or corporation shall conduct or operate a food establishment, including a mobile unit (with retail sales), or a food and/or beverage vending machine within the Township without first having procured from the Board of Health a license to do so and paid the prescribed fee in subsection
BH2-2.2.
b. Any license issued pursuant to this chapter shall not be transferable.
c. All licenses issued under this chapter shall expire on December 31
of the year in which issued.
d. All licenses issued under this chapter shall be posted in a conspicuous
space.
e. All food establishments shall be operated in compliance with the
provisions of the Food Establishment Code and with all other applicable
provisions of the State of New Jersey and ordinances of the Township.

a. All establishments where food is handled will pay a fee of $100.
b. All mobile units selling retail will pay a fee of $50.
c. Nonprofit organizations, veterans and disabled persons will be exempt
from the payment of the fee but must apply for a license.
d. The fee for a vending machine is $10.

Any person or corporation who shall violate any provision of this chapter shall, upon conviction, be liable to the penalty stated in Chapter
BH1, Section
BH1-2.

The Board of Health of the Township shall be responsible for
the administration and enforcement of this chapter.

a. It shall be unlawful for any person or corporation to maintain coin-operated
machines in the Township used for the sale of food or drink without
having first procured an annual license from the local Board of Health.
b. The annual license fee for such food and beverage machines is hereby
fixed as follows: each machine with a separate coin slot shall pay
an annual fee of $10 and shall have attached to it a sticker with
the following legend:
This machine is licensed by the Board of Health of the Township
of Upper Freehold License No. _____ Effective from January 1, 20 _____
to December 31, 20 _____
c. The license fee shall be from January 1 to December 31. A license
for a part of a calendar year shall carry the full annual license
fee.
