This chapter and future amendments will eventually contain all fees to be charged by the Township of Upper Freehold and its agencies, to the extent that the Township has the power to set such fees. In the event another level of government shall be exclusively empowered to set a fee or empowered to set a maximum fee, and there is a conflict with the fee set forth in this chapter, the fee or maximum allowable fee as determined by the other level of government shall control. In the event the amount of a fee set forth herein shall conflict with the fee set forth in any other provision of the Code of the Township of Upper Freehold, the fees in this chapter shall control.

The fees contained in subsection 2A-4.1 a through d inclusive may be modified from time to time by resolution of the Township Committee without modifying the within subsection. A copy of any modifying resolution shall be maintained by the Township Clerk and shall be available during normal business hours.

Programs are open to all Upper Freehold Township residents. All registrations are accepted on a first-come, first-serve basis. Space is limited for some programs. Registrations and payments, in the form of cash or check, are accepted at the Recreation Department office. Checks should be made payable to "Upper Freehold Township."

The Recreation Department reserves the right to cancel any program if there is insufficient enrollment or change any of the dates, times, locations, ages, fees or other information for any program. All registration fees for cancelled programs will be refunded.

Registrants who wish to withdraw prior to the start of a program may be issued a refund only if the Recreation Department is notified in writing at least 10 days prior to the starting date of the program. A 20% administrative service charge will be imposed for all refunds granted. No refunds will be granted after a program has started. The summer camp program has a separate refund policy, which will be noted on pertinent registration information. Program fees for certain programs are nonrefundable.

A penalty fee of $50 per program will be charged for checks returned by the bank for insufficient funds. To maintain registration in the program, registrant must pay registration and penalty fee in cash.

There shall be fees charged to the Upper Freehold-Allentown Little League and Upper Freehold/Allentown Softball; the Upper Freehold-Allentown Soccer Association; the Central Redbirds Pop Warner; AUFAA Lacrosse; Travel teams and other organized groups that regularly schedule games and practices on Upper Freehold Township Recreation Fields including but not limited to those sites known as:

All sports organizations using these facilities will pay Upper Freehold Township a fee based on the number of participants registered for the subject organization at the time of use and upon execution of the required use agreement.

Permits.
1. 
Residents of Upper Freehold Township may apply for a permit for a date and time to reserve a specific athletic field or court or recreational facility for individual use in accordance with the Rules and Regulations at the Upper Freehold Township Resident or Group Rate.
2. 
Travel teams/organized groups comprised of not less than 50% and not more than 80% of Upper Freehold residents shall be charged Monmouth County Resident or Group rates.

a. 
Person. Any Upper Freehold Township and Monmouth County person may apply for a permit to reserve a specific athletic field and/or court. Said written application shall be filed at least three days prior to the requested date and time with Upper Freehold Township and its Director. Such a permit may be issued in the discretion of the Recreation Director so as to allow for the orderly scheduling of the use of said fields and courts and facilities. When a permit is issued, the person holding such permit shall have the exclusive use of the field or court area for the specific date and time designated only.
b. 
Recreation facilities shall be managed for the benefit of the residents of Upper Freehold Township and the County of Monmouth. Priority of reservations and use shall be granted to organizations serving the recreational needs of Upper Freehold Township, Allentown and the area of western Monmouth County consistent with the improvements constructed by Upper Freehold Township and help from various contributions by persons and entities for such purposes. All permits are only issued in the discretion of Upper Freehold Township and its Recreation Director.
c. 
Group and Entity. Permits shall be obtained by written application for any nonprofit organized groups and entities for use of the athletic fields and courts or recreational facilities. Said application shall be filed at least two weeks prior to the requested date and time. Permits may be issued only in the discretion of Upper Freehold Township and its Recreation Director.
All organized groups using any of the Parks' facilities shall assume full responsibility for any and all injuries and damages that may occur during any event and use. The group and organization using the facilities by permit agree that it and they shall defend and indemnify Upper Freehold Township and its agents, servants and employees from and with respect to any and all claims for personal injury and property damage and other claims involving said facilities and/or use that may be made against the Township and its representatives and agents, servants and employees. With each application, the organization and/or organized group and entity shall submit an original Certificate of Liability Insurance that shall include Comprehensive General Liability Insurance coverage in the minimal amount of $1,000,000/$2,000,000 and Workers Compensation coverage and other appropriate insurable interests. The Certificate shall name Upper Freehold Township, a New Jersey Municipal Corporation, as an additional named insured. Failure to provide a proper Certificate of Insurance with the application and prior to use shall void any field and court use and no permit shall be issued without said Certificate being provided to the Recreation Director for review and in discretion, the Director's approval or rejection.
d. 
All fee payments and/or deposits shall be payable to Upper Freehold Township and shall only be sent and directed to and/or hand delivered to the Upper Freehold Township Recreation Director, Township Municipal Building, 314 Route 539, Post Office Box 89, Cream Ridge, New Jersey 08514-0089. All correspondence shall be directed to that office also.
e. 
Upper Freehold Township and its Recreation Department may require that the group or organization provide the services of a police officer or officers in order to utilize the facilities. In that event the organization or group shall provide officers that are duly qualified and the officers shall be compensated by the applicant and organization at the established rate for such officers.
f. 
If required, a deposit shall be paid to Upper Freehold Township in the amount of $500 in the discretion of the Recreation Director to insure that the buildings and grounds will be properly utilized and also left in a clean, safe and sanitary condition. A representative from Upper Freehold Township shall examine the grounds and facilities following use by such group or organization and in the event all rules have been complied with and the fields and facilities are left in proper condition, the deposit may be returned to the applicant and permittee within 60 days. If the rules and/or other conditions have not been complied with, the deposit shall be forfeited.
In addition, the Township reserves the right to seek such other remedies and relief as may be appropriate in accordance with applicable law.
g. 
Written applications and requests for fields and courts and recreational facilities shall be accepted only after February 15 or the first business day thereafter from organizations and groups and/or individuals seeking use commencing March 1 to June 30. Any request and application shall be solely considered by Upper Freehold Township in the discretion of its Recreation Director.
Requests for fields and courts and recreational facilities for use commencing July 1 and ending August 31 shall be accepted commencing June 1 or the first business day thereafter and again, shall be considered in the discretion of the Recreation Director.
Requests for use starting September 1 and ending December 1 shall only be accepted commencing August 1 or the first business day thereafter.
h. 
Upper Freehold Township and its Recreation Director shall be notified a minimum of 48 hours in advance of any cancellation or change with respect to any approved application and issued permit. Failure to notify Upper Freehold Township and its Recreation Director personally and in writing in accordance with said forty-eight hour notice may result in forfeiture of any fees paid and/or suspension of any future use or such other remedy or action as Upper Freehold Township and/or Recreation Director may deem appropriate.

a. 
The Upper Freehold-Allentown Little League and Upper Freehold/Allentown girls' softball and the Central Redbirds Pop Warner shall have the sole option to utilize the concession stands and facilities in their respective seasons. In the event the organizations do not wish to operate the stand and concession facilities, they shall serve written notice of same upon Upper Freehold Township and its Recreation Director with a copy to the Township Clerk/Administrator at least 60 days prior to the season opener.
Each organization shall pay to Upper Freehold Township a deposit in the sum of $300 to insure that the facilities and area will be kept in a clean, safe and sanitary condition each day. A representative from Upper Freehold Township and its Parks, Playgrounds and Recreation Department shall examine the concession facilities and area following the use of same by such groups and organizations. At the end of the season, in the event it has been determined that said organizations have fully complied with all rules and regulations and the facilities and area have been adequately cared for and kept picked up of trash and debris and do not need repair and are in good condition, normal use and wear excepted, then the Township and/or Director may, in its discretion, return the deposit to said organization. In the event it is determined that damage has occurred and/or the rules have not been complied with and/or the terms of this provision or other related rules have been violated, the deposit may be forfeited in the discretion of Upper Freehold Township and its Recreation Director. In addition, said organizations will be subject to such other costs and assessments and remedies as Upper Freehold Township may, in its discretion, pursue in accordance with law.
