A. 
No person shall consume any alcoholic beverages within the limits of the Borough of Athens or have in his possession any opened alcoholic beverage container with unconsumed alcoholic beverage therein:
(1) 
While in or on a public street, sidewalk, public parking place, park, playground, school building or grounds or any other public or quasi-public place or in any public conveyance.
(2) 
While in a private motor vehicle while the same is in motion or parked in any public street, public parking lot or other public or quasi-public place.
B. 
No person shall discard alcoholic beverage containers upon any public street, lane, sidewalk, public parking lot, public or quasi-public place or upon any private property not his own without the express permission of the owner.

A. 
Notwithstanding anything hereinabove contained, the Borough of Athens shall authorize the Athens Borough Fire Board to serve and sell alcoholic beverages in the pavilion located in the Athens Borough Park on River Street, provided that adequate insurance is secured and approved by the Council.
B. 
The Borough of Athens may authorize the use of alcoholic beverages in Borough-owned parks through the permit requirements set forth in Chapter 359, Parks and Recreations Areas, § 359-9, Permit requirements; application procedure.

Any person who violates or permits a violation of this chapter shall, upon conviction in a summary proceeding under the Pennsylvania Rules of Criminal Procedure, be guilty of a summary offense and shall be punishable by a fine of not more than $1,000, plus court costs and reasonable attorneys' fees incurred by the Borough in the enforcement proceedings. Upon judgment against any person by summary conviction, or by proceedings by summons on default of the payment of the fine or penalty imposed and the costs, the defendant may be sentenced and committed to the county correctional facility for a period not exceeding 30 days. Each day that such violation exists shall constitute a separate offense, and each section of this chapter that is violated shall also constitute a separate offense. In addition to or in lieu of enforcement under this section, the Borough may enforce this chapter in equity in the Court of Common Pleas of Bradford County.
