A certain document, three copies of which are
on file in the office of the Borough Secretary of Borough of Athens,
being marked and designated as the "International Fire Code," including
Appendix Chapters A, B, C, D, E, F and G (see International Fire Code,
§ 101.2.1, 2000 Edition), as published by the International
Code Council, be and is hereby adopted as the code of the Borough
of Athens for regulating and governing the safeguarding of life and
property from fire and explosion hazards arising from the storage,
handling and use of hazardous substances, materials and devices and
from conditions hazardous to life or property in the occupancy of
buildings and premises in the Borough of Athens and providing for
the issuance of permits for hazardous uses or operations; and each
and all of the regulations, provisions, conditions and terms of such
International Fire Code, 2000 Edition, published by the International
Code Council, on file in the office of the Borough Secretary are hereby
referred to, adopted and made a part hereof as if fully set out in
this chapter.
The following sections are hereby revised:
A. Section 101.1
insert "Athens."
B. In Section 109.3,
insert "violation of ordinance," "$1,000" and "30 days."
C. In Section 111.4,
insert "$500" and "$1,000."
D. Sections 307.2,
Permit required, and 307.2.1, Authorization, are repealed.

307.2.2 Prohibited open burning. Open burning shall be prohibited in the Borough unless an authorized
exception.

F. Section 307.3.1
is amended as follows:

307.3.1 Bonfires. A bonfire shall
not be conducted within 25 feet (7,620 mm) of a structure or combustible
material unless the bonfire is contained in a barbecue pit. Conditions
which could cause a fire to spread within 25 feet (7,620 mm) of a
structure shall be eliminated prior to ignition. The only bonfires
allowed in the Borough shall be in the River Street Borough Park for
a nonprofit organization overnight upon obtaining a permit from the
Code Officer.

G. Section 307.3.2
is amended as follows:

307.3.2 Recreational fires. The
only material that may be burned in a recreational fire shall be wood
that is untreated and unpainted, wood purchased in a store such as
fire logs, charcoal, and an approved propane gas or natural gas supply.
The burning of garbage, cardboard, magazines, newspaper, and paper
continues to be prohibited.

H. Section 307.4
is amended as follows:

307.4 Attendance. Recreational
fires or a bonfire at the Borough Park shall be constantly attended
until the fire is extinguished. A minimum of one portable fire extinguisher
complying with Section 906 with a minimum 4-A rating or other approved
on-site fire-extinguishing equipment, such as dirt, sand, water barrel,
garden hose or water truck, shall be available for immediate utilization.

The limits referred to in certain sections of
the 2000 International Fire Code are hereby established as follows:
A. Section 3204.3.1.1
(limits in which the storage of flammable cryogenic fluids in stationary
containers is prohibited).
B. Section 3404.2.9.5.2
(limits in which the storage of Class I and Class II liquids in above-ground
tanks outside of buildings is prohibited).
C. Section 406.2.4.4
(limits in which the storage of Class I and Class II liquids in above-ground
tanks is prohibited).
D. Section 3804.2
(limits in which the storage of liquefied petroleum gas is restricted
for the protection of heavily populated or congested areas).
Ordinance No. 456 of the Borough of Athens,
entitled "Fire Prevention — BOCA National Fire Prevention
Code, 1997," and all other ordinances or parts of ordinances in conflict
herewith are hereby repealed.
