The following words and phrases, as used in this chapter, shall have the meanings ascribed to them in this section, unless the context indicates a different meaning:
BREACH OF THE PEACE
Behavior that is contrary to law, such as tends to disturb the public peace or decorum, scandalize the community or shock the public sense of morality.
FIREWORKS
Includes any combustible or explosive composition or any substance or combination of substances, or, except as hereinafter provided, any article prepared for the purpose of producing a visible or an audible effect by combustion, explosion, deflagration or detonation, and shall include blank cartridges and toy cannons in which explosives are used, the type of balloons which require fire underneath to propel the same, firecrackers, torpedoes, skyrockets, Roman candles, aerial fireworks or other fireworks of like construction, and any fireworks containing any explosive or flammable compound or any tablets or other device containing an explosive substance.
A. 
It shall be unlawful for any person to commit a breach of the peace, disorderly conduct or to engage in fighting or to incite others to fight or to engage in any unlawful act tending to imperil personal security or to endanger or damage property within the Borough.
B. 
No person shall use any profane, obscene or indecent language upon any street or other public place; nor shall any person mark, write, inscribe or draw upon any building, billboard, sign, public toilet or any public place any vulgar, lewd, indecent or suggestive picture, design or word.
C. 
No person shall publicly commit any act of lewdness or indecency or exposure of person or become intoxicated.
D. 
No person shall loaf, loiter or stand upon any of the sidewalks or other public places or highways so as to interfere with the free and full passage of residents or travelers.
E. 
No person shall give or suffer or permit the giving of any indecent, immoral, lewd or vulgar show, performance or moving picture; nor sell, give or cause, suffer or permit to be shown or displayed any vulgar, lewd, immoral or suggestive picture, thing or device tending to shock the sense of public decency or propriety.
F. 
No person shall carry or conceal, possess, use, or offer for sale any fireworks of any character at any time; place on, across or above any highway or sidewalk any object which might endanger pedestrian or vehicular traffic or throw on or into any sidewalk or highway any stones, snowballs or other material; or raise any false fire alarm.

G. 
No person shall interfere with Borough police officers, resist arrest or fail to render assistance to the Police Officer when called upon by him or tamper with, destroy or otherwise interfere with any caution or warning lights, barricades, traffic cones, signs or other property or materials placed in public places by the Borough or any of its officials.
H. 
No person shall display, post up, exhibit, paint, print or mark, place or cause to be place any placard, bill, poster, painting, sign or similar item as an advertisement or otherwise on any building, billboard, wall, fence, tree, lamppost, pole or otherwise so as to be visible from any street, sidewalk or public place without the prior written consent of the owner.
I. 
In no event shall any person display, post up, exhibit, paint, print or mark, contain or depict any vulgar, lewd, indecent or suggestive picture or design or contain or depict any words tending to shock the sense of public decency or propriety.

Any person who violates or permits a violation of this chapter shall, upon conviction in a summary proceeding under the Pennsylvania Rules of Criminal Procedure, be guilty of a summary offense and shall be punishable by a fine of not more than $1,000, plus court costs and reasonable attorneys' fees incurred by the Borough in the enforcement proceedings. Upon judgment against any person by summary conviction, or by proceedings by summons on default of the payment of the fine or penalty imposed and the costs, the defendant may be sentenced and committed to the county correctional facility for a period not exceeding 30 days. Each day that such violation exists shall constitute a separate offense, and each section of this chapter that is violated shall also constitute a separate offense. In addition to or in lieu of enforcement under this section, the Borough may enforce this chapter in equity in the Court of Common Pleas of Bradford County.
