A certain document, one copy of which is on file in the office of the Code Agency and one copy of which is on file with the Athens Borough Solicitor, being marked and designated as the "2015 International Residential Code," including Appendix chapters, as published by the International Code Council, is hereby adopted as the code of the Borough of Athens for regulating the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of one- and two-family dwellings and townhouses not more than three stories in height in the Borough of Athens, and providing for the issuance of permits, and collection of fees therefor; and each and all of the regulations, provisions, conditions and terms of such International Residential Code, 2015 Edition, published by the International Code Council, on file in the office of the Borough Secretary are hereby referred to, adopted and made a part hereof as if fully set out in this article.
The following sections are hereby revised:
A. 
In Section R101.1, insert: "Athens."
B. 
In Table R301.2(1), insert "Minimum design loads for buildings and other structures (ASCE-7) and Appendix A-K."
C. 
Add Section R113.5 to read as follows:

R113.5 Violations and penalties. Any person who violates a provision of this code is subject to the following:

Prosecution of ordinance violators; disposition of fines, penalties and costs. Any violation or failure to comply with any provision of any Borough ordinance shall constitute a summary offense, and prosecution for every such offense shall be according to the practice in the case of summary convictions.

Collection of penalties. No fine or penalty shall exceed $1,000 for a violation of a building, housing, property maintenance, health, fire or public safety code or ordinance and for water, air and noise pollution violations and shall not exceed $600 for a violation of any other Borough ordinance.

Any person who shall violate any provisions of this chapter shall, upon conviction thereof, be punishable by a fine of not more than $1,000, plus costs of such proceedings, or by imprisonment in the county jail for a term of not more than 30 days, or both. The continuation of such violation for each successive day shall constitute a separate offense, and the person or persons allowing or permitting the continuation of the violation may be punished as provided above for each separate offense.
Ordinance No. 453 of Borough of Athens, entitled "CABO One and Two Family Dwelling Code, 1992 Edition," and all other parts of ordinances in conflict herewith are hereby repealed.
Nothing in this article or in the CABO One- and Two-Family Dwelling Code hereby adopted shall be construed to affect any suit or proceeding impending in any court or any rights acquired or existing, under any act or ordinance, nor shall any just or legal right or remedy of any character be lost, impaired or affected by this article.
