The Toms River skatepark is an unsupervised facility. Skatepark patrons
use the facility at their own risk. The Township of Toms River does
not assume any responsibility for damage or injuries resulting from
the use of the facility.
All users of the park must execute, on a form approved by the Ocean
County Joint Insurance Fund and promulgated by the Township, an acknowledgment
of risk and waiver and release of all claims. For users who are minors,
this form must be executed by a parent or legal guardian. Failure
to execute this form precludes use of the skatepark.
The skatepark is strictly for skateboarding, with skateboards of
a maximum length of 34 inches and scooters. All other uses, including
but not limited to in-line roller skates, bicycles, and other wheeled
vehicles, are strictly prohibited.
Skateboarding is a high-risk activity. All users under 18 years of
age are required to wear a helmet at all times. All users are strongly
recommended to wear helmets, knee pads, elbow pads, and wrist guards
at all times.
All skatepark users must possess an individually numbered identification
tag issued by the Department of Recreation. This tag must be worn
at all times while using the park and is nontransferrable.
Copies of the skatepark rules and regulations shall be provided by
the Department of Recreation along with the issuance of the identification
tag.
Signs depicting the rules and regulations established hereunder
shall be prominently displayed at the entrance of and at certain points
inside the skatepark.
Persons who violate the rules and regulations established pursuant
to this article are subject to prosecution and to the maximum fines
and penalties imposed pursuant to N.J.S.A. 40:49-5 and N.J.S.A. 40:69A-29,
and any subsequent amendments to those statutes, for each offense.
