A. Due to recent changes in the New York Civil Service Law, the local
county civil service commissions will be responsible for collecting
and processing fees for civil service employment applications, and
said county commissions will not be able to waive said fee without
the permission of New York State Civil Service. Said state legislation
contains a vehicle for a County applicant to get said fee waived by
the New York State Civil Service Commission if said applicant certifies
that they are unemployed and primarily responsible for the support
of a household.
B. The Albany County Civil Service Commission adopted a resolution on
July 17, 1989, to establish a fee of $10 per application, of which
$5 would be forwarded to the New York State Civil Service Commission.
Said fee was determined by the County Civil Service Commission based
on the inherent additional costs rendered in collecting and accounting
for the fee payable to the State of New York as mandated in the New
York State Civil Service Law.
C. The actions of Albany Civil Service Commission in establishing a
$10 fee for civil service employment application on applications for
full-time positions that pay $5,000 per annum or more is hereby endorsed
and approved for commencement on October 1, 1989.

The County Legislature hereby authorizes the imposition of access
fees for commercial operators and vehicles and vehicles for hire to
access the new loading and unloading zone to be established for their
use as follows:
A. Taxi and passenger stage operators:
(1) The term "passenger stage operator," as used in the context of this
section, shall mean those operators serving groups of unrelated parties
traveling to a common destination (e.g., a particular hotel, city
or resort). The contract taxi company will be required to offer these
services. Any independent passenger stage operators will be handled
in a similar manner to independent tax operators.
(2) In recognition of the dependability of a contractual operator and
the need to treat independent taxi and passenger stage operator owners
in a nondiscriminatory manner, a two-tier system is proposed:
(a)
The airport will solicit requests for proposals from taxi companies
for a guarantee of at least 15 vehicles to service the airport with
taxi and passenger stage services and a minimum $500 monthly rental
fee. The successful bidder will be granted the following exclusive
rights: use of a counter in the baggage claim area for dispatching;
airport terminal and brochure advertising; the right to position their
starters in front of the terminal; and vehicle staging in the foremost
area in front of the baggage claim area as set forth in the above-mentioned
commercial vehicle staging area. In addition, the successful bidder
will be required to purchase at least 15 access cards in increments
of $500 each, with a built-in bonus of 15 trips (515 trips/$500).
A card reading system will debit each card for $1/trip into the staging
areas. No time limits will be set. The airport will notify the taxi
company when any card reaches $450 in debits. Access cards will be
deactivated if credits are depleted. In the event a card has been
deactivated, no access to the staging area will be possible. The operator
would have to use the alternative loading/unloading zone located in
the proximity of the public economy lot.
(b)
Independent taxi companies or independent passenger stage operators
will be staged separate from the contractual operator. Independents
will be urged to purchase access cards for $500 each and will also
be offered the 15 free trips incentive. The Airport will notify an
independent when any card(s) reaches $450 in debits. Deactivation
of cards and use of the alternate loading/unloading zone will also
apply to independents.
B. Luxury limousine and charter party carriers.
(1) The term "charter party carrier," in the context of this section,
shall mean those operators providing ground transportation service
provided to groups traveling together for a common purpose, (e.g.,
sport teams, related parties, entertainers).
(2) Luxury limousine and charter party carriers will be required to purchase
an access card which permits 100 entrances to the commercial vehicle
loading/unloading zone. The cost of the card will be $125 as follows:

(3) The Airport will notify the operator when 75 trips have been made.
The operator may purchase additional trips in blocks of 100 at $1
per trip.
(4) Some luxury limousine and charter party carriers may still desire
curbside access. The airport will charge $1,000 per year per vehicle
parking space. A limited number of these spaces will be available.
Vehicles will be medallioned for identification purposes. Luxury limousine
and charter party carriers will pay this premium rate for the privilege
of staging their vehicles along the terminal access roadway and then
picking up their passengers in front of the terminal near the baggage
claim area (see CT Male design). Upon arrival, luxury limousine and
charger party carrier drivers will be allowed to park their vehicles
along the meridian that separates the roadway from the rent-a-car
ready lot while they go into the terminal to meet their passengers
and direct them to wait in front of the terminal for pick-up. Any
luxury limousine and charter party carrier not bearing a medallion
will be directed to the public parking areas.
C. Hotels/Motel courtesy vans. Hotel/Motel courtesy vans will be assessed
at $500/year per vehicle. Vehicles will be medallioned for identification
purposes. This fee reflects the fact that although hotels/motels do
not divert great amounts of money from the Airport, they are heavy
users of the Airport roadways and should share in the cost of maintenance.
D. Off-Airport rent-a-car companies.
(1) Off-Airport rent-a-car companies will be required to purchase an
access card which permits 100 entrances to the commercial vehicle
loading/unloading zone at no charge. The cost of the card will be
$525 as follows:

(2) The Airport will notify the operator when 75 trips have been made.
The operator may purchase additional trips in blocks of 100 at $5
per trip.
E. Off-Airport parking lots. Off-Airport parking lots will be assessed
at $5,000/year per shuttle vehicle. Each shuttle will be medallioned
for identification purposes. The operator will be issued one access
card per vehicle, which shall allow unlimited trips for that vehicle.
Additionally, each off-Airport parking company shall have the option
of leasing an exclusive loading/unloading zone at a cost to be determined
by competitive bid. The term of the lease will be 12 months.
F. Exclusive use lanes. It is proposed that all commercial vehicle lanes
will be available on a "common use" basis. However, certain operators
may desire exclusive use lanes within the commercial vehicle loading/unloading
zone. Exclusive use lanes will be offered on a lease basis to the
highest bidders. Such exclusive lanes are desirable to those operators
seeking higher visibility at the Airport and to those seeking to offer
their patrons an enhanced level of service and convenience.

A. Real Property Tax Law § 503(7) authorizes a county legislature,
by resolution, to establish certain fees to be paid to the Real Property
Tax Service Agency by any person or corporation filing a map in accordance
with the provisions of any general, special or local law or ordinance.
B. Effective upon the adoption of this resolution, the sliding scale
charges outlined in Real Property Tax Law § 503 for Tax
Map filings are hereby established and adopted by this Legislature
as fees to be paid to the Albany County Real Property Tax Service
Agency by any person or corporation filing a map in accordance with
the provisions of any general, special, local law or ordinance.

The Albany County Legislature hereby establishes a nonprofit
rental rate plan and implementation guidelines for operation of the
Knickerbocker Arena as follows:
A. Nonprofit rental rate.
(1) Arena: $3,000 or 10% of gross ticket sales, whichever is greater,
plus expenses.
(2) Exhibition hall: $750 plus expenses.
(3) Subject to the eligibility guidelines as follows.
B. Guidelines for nonprofit rental rate at Knickerbocker Arena.
(1) The County will allow up to 10 nonprofit rental rate days annually
for the benefit of the community. Said nonprofit rental rate days
shall not be deemed to be a County use day under the agreement between
the County and Spectacor Management. Direct and out-of-pocket expenses
incurred in connection with such nonprofit rental rate usage shall
be paid by the lessee. Said usage will be subject to availability
and will not conflict with dates already booked or proposed to be
booked with SMI. The organization requesting days for special events
must have a reputation as a responsible one which enhances the quality
of life and morale within the community and will meet the following
criteria:
(a)
Geographical priority will be given to Albany County organizations.
(b)
Approval of waiver days is restricted to organizations and programs
that demonstrate the ability to have a significant impact on the need
being addressed.
(c)
The event can generate income for a defined program of the organization
but not for the organization's general fund.
(d)
The organization must be able to demonstrate how the program
will benefit the community.
(e)
The organization must show a financial need for a nonprofit
rental rate.
(f)
The event must be sponsored by a registered nonprofit organization
or by a municipal organization.
(g)
With a minimum of 45 days' prior notice, SMI of Albany will
move the event or reschedule the date in the event that SMI of Albany
is able to book a major show and the only date that she can happen
conflicts with the organization event date. If SMI of Albany is unable
to give the organization 45 days' notice due to circumstances beyond
SMI's control, the organization will work along with SMI to explore
all available scheduling options to accommodate SMI's scheduling conflict.
(2) To apply for a nonprofit rental rate:
(a)
Requests will be submitted in writing, six months in advance,
to the General Manager of the Knickerbocker Arena. All written applications
will include:

A brief description of the organization and the project or event
to be sponsored. The beneficiaries and the program will be identified.
[2]
A brief itemized budget and plan for funding the project, including
peripheral costs and consulting fees.
[3]
Identification of the financial need to be met.
[4]
Evidence that the organization is a 501(c)(3) nonprofit organization.
[5]
A financial report for the organization.
[6]
Listing of the organization's board of directors.
(b)
The General Manager of the Knickerbocker Arena will review the
written application and make a determination of the appropriateness
of granting a nonprofit rental rate to the organization, and if he/she
deems it appropriate may consult with the Civic Center Committee for
its recommendations. The ultimate decision with regard to granting
the nonprofit rental rate in any event will be made by the General
Manager of the Knickerbocker Arena.

Fees charged by the Director of Weights and Measures shall match
the schedule of fees adopted by New York State regarding County inspections
as indicated in a spreadsheet filed with the Clerk of the Legislature.

D. Both the state and County fee charged by Albany County for civil
service promotional exams taken by Albany County employees for Albany
County positions and open competitive exams taken by Albany County
employees for Albany County positions are hereby waived.

The Albany County Legislature hereby authorizes the facility
fee proposed by SMG on tickets for all events at the Pepsi Arena negotiated
after May 1, 2001.
A. Said facility fee shall be in the amount of $1 per event ticket and
$1 per event ticket for a team home game ticket priced at less than
$7.50.

B. Team tenant season ticket sales shall be exempt from the payment
of said facility fee during the existing terms of agreements with

A. The County Department of Economic Development, Conservation and Planning
is authorized to sell Albany County Tax Maps and County-generated
GIS mapping data in digital format to the public upon request.
B. The County Attorney, in consultation with the Departments of Economic
Development, Conservation and Planning and Management and Budget and
the RPTSA, shall draft a licensing agreement and fee schedule consistent
with the requirements of FOIL, the County's copyright rights and restrictions
imposed by the County's participation in the State GIS Cooperative
Data Sharing Agreement.

A. The Department of Public Works is authorized to institute a $10 special
hauling permit fee on an annual basis and a $50 per vehicle/per trip
administrative fee for overweight and oversize vehicles traveling
on Albany County roads, effective January 1, 2006.
B. This section shall allow the County to issue area permits, which
would apply to all County roads unless specifically exempted due to
road construction, road geometry or bridge conditions.

(1) Area permits shall apply to vehicles with a total gross weight of
less than 108,000 pounds, a width equal to or less than 12 feet, a
height equal to or less than 13.5 feet and a length of less than 80
feet, inclusive of load and bumpers.
(2) Fees for area permits are $10 for an annual hauling permit and a
$50 per vehicle/per month or $380 per vehicle/per year administrative
fee for overweight and oversize vehicles traveling on Albany County
roads starting January 1, 2009.
