For the purpose of this chapter, the terms used
herein are defined as follows:
PARK OR PARKS
All property and area owned by or under the control of the
Village set aside and maintained for recreational and athletic uses
and enjoyment by the public, all entrances and exits thereto, all
roads, walks, paths, trails, bridal paths, bodies of water, lakes,
ponds, streams, waterways, swimming pools, marinas, bathing beaches
and areas, tennis courts, baseball fields, handball courts, band shells,
any athletic and game facility, apparatus and equipment, structures,
buildings and parking areas located within or used and maintained
in connection therewith.
Any person or persons disobeying or failing
to respond to any order, direction or command of a Village official,
security officer, peace officer or officer of the Suffolk County Police
Department or the direction of any park sign or notice; using threatening,
abusive or insulting language; doing any obscene or indecent act;
throwing stones or other missiles; annoying or assaulting any person
or persons; interfering with, encumbering, obstructing or rendering
dangerous in any manner any road, path, walk, trail, waterway, swimming
pool or beach; doing any act tending to or amounting to a breach of
the peace; climbing upon any wall, fence, shelter, seat or other structure,
entering or leaving any park area except at establishing entranceways
or exits; carrying or firing any firecrackers or fireworks; engaging
in, instigating, aiding or encouraging any fight, riot or disturbance;
playing games of chance or gambling; operating minibikes; bringing
into any park or having in his or her possession while there, using,
dispensing or offering to sell or disposing of any drug, narcotic,
wine, spirit and alcoholic drink or beverage, unless special permission
is obtained from the Village Board; damaging, defacing, destroying
or rendering unusable any sign, direction, fence, gate, barrier, structure
or equipment; marking with any substance or writing upon any sign,
direction, walk, road, structure, equipment or apparatus; casting,
depositing or throwing on any road, walk, path or surface any refuse,
material, paper, cardboard, metal cans, bottle or container for any
consumable substance; destroying or damaging any tree, shrub, planting,
lawn or cultivated area; burning any material, waste, refuse and trash,
whether or not the same is in any container or basket for collection;
or assembling and congregating for the purpose of holding a meeting
or addressing an audience shall be guilty of disorderly conduct.
No person or persons shall loiter or remain
within a park or any area thereof, in any vehicle or otherwise, after
the posted closing hour or time of day for the closing of such park
or park area without general or special permission, in writing, from
the Village Administrator Clerk as ordered by the Board of Trustees.
The Board of Trustees may, by resolution duly
adopted, fix the time when parks shall be open to public use, the
closing hour or the time of day for the closing of such park or any
park area. The time of use and closing hour shall be posted conspicuously
at any entrance and exit to any park and any other places within the
park as required.
Boating of any kind on any inland lake, pond
or body of water is forbidden except such boating as is necessary
to keep such areas properly protected and policed.
Ice skating is forbidden upon any lake, pond
or body of water, except at such times and under circumstances when
ice conditions permit and notice of permission is posted by sign or
device displayed at the location.

No organization, league or group of individuals
numbering more than 10 persons shall make use of any Village park
or field for the purpose of playing baseball or softball unless a
permit to do so has been obtained from the Lindenhurst Village Board.

It shall be a violation of this chapter for any person to smoke
or carry any lighted smoking substances or other smoking devices,
including but not limited to cigarettes, electronic cigarettes, cigars,
pipes and the like, at any park within the Village of Lindenhurst,
including indoor and outdoor locations, except in designated smoking
areas as indicated by posted signs.

Any person, corporation or association violating
any of the provisions of this chapter shall, upon conviction thereof,
be punishable by a fine of not less than $100 nor more than $1,000
or a term of imprisonment not exceeding 15 days, or both.
