As used in this Chapter, the following terms shall have the
meanings indicated:
RECREATIONAL MARIJUANA CULTIVATION FACILITY
A facility licensed by the State of Missouri to acquire,
cultivate, process, store, transport, and sell marijuana to a recreational
marijuana dispensary facility, recreational marijuana testing facility,
or to a recreational marijuana-infused products manufacturing facility.
RECREATIONAL MARIJUANA DISPENSARY FACILITY
A facility licensed by the State of Missouri to acquire,
store, sell, transport, and deliver marijuana, marijuana-infused products
and drug paraphernalia used to administer marijuana as provided for
in this Section to a person no less than twenty-one (21) years of
age, qualifying patient, a primary caregiver, another recreational
marijuana dispensary facility, a recreational marijuana testing facility,
a recreational marijuana cultivation facility, or a recreational marijuana-infused
products manufacturing facility.
RECREATIONAL MARIJUANA-INFUSED PRODUCTS MANUFACTURING FACILITY
A facility licensed by the State of Missouri, to acquire,
store, manufacture, transport, and sell marijuana-infused products
to a recreational marijuana dispensary facility, a recreational marijuana
testing facility, or to another recreational marijuana-infused products
manufacturing facility.

Facilities shall remain compliant with Section 1 of Article
XVI of the Constitution of the State of Missouri.

A. Recreational marijuana facilities are prohibited within set distances of schools, child day cares, and churches all as defined in Section
405.020, Definitions, of the City of Poplar Bluff Code of Ordinances. Distance requirements from residential neighborhoods are also provided below.

No marijuana-related uses shall be operated or maintained within
five hundred (500) feet of any school, child day-care facility, or
church.
2.
No marijuana-related uses shall be operated or maintained on
any portion of a lot where any portion of said lot is within one hundred
(100) feet of a residentially zoned district, public park, or public
library. This measurement shall be from the front door of the facility
to the closest property line of the residentially zoned district of
the property line of the public library.

In the case of a freestanding facility, the distance between
the facility and school, child/day-care facility, or church shall
be measured from the external wall of the facility structure closest
in proximity to the school, day care, or church to the closest point
of the property line of the school, day care, or church.
4.
In the case of a facility that is part of a larger structure,
such as an office building or strip mall, the distance between the
facility and the school, day care, or church shall be measured from
the property line of the school, day care, or church to the facility's
entrance or exit closest in proximity to the school, day care, or
church.
5.
Measurements shall be made along the shortest path between the
demarcation points that can be traveled by foot.

No marijuana-related use facility shall emit an odor or in any
way cause a public nuisance. Appropriate ventilation systems to prevent
any marijuana odor or fumes from leaving the premises may be required
if a public nuisance occurs.

Recreational marijuana facilities shall not use signage or advertising
to promote use by minors.

Hours of operation of all recreational marijuana dispensary
facilities, including delivery and distribution, are restricted to
7:00 A.M. to 10:00 P.M.
