Wherever a space is marked off on any street for the parking
of an individual vehicle, every vehicle parked there shall be parked
wholly within the lines bounding that space, and it shall be a violation
of this article for any person to park a vehicle or allow it to remain
parked otherwise.

A. It shall
be a violation for any person to stop, stand or park a vehicle on
the roadway side of any vehicle stopped or parked at the edge or curb
of any street, except that standing or parking for the purpose of
loading and unloading persons or property shall be permitted. This
section means that the vehicle that is stopping for delivery must
be stopped no longer than necessary for the loading and unloading.
Further, the driver of the delivery vehicle must ensure that the stopping
will not block in any other vehicle and will be mindful of the traveling
public.
B. The driver
of the delivery vehicle must use good judgment when stopping the delivery
vehicle. The stopping vehicle must not be stopped in a blind intersection
or in such a way as to stop traffic or in any way cause a dangerous
situation for the traveling public.
C. With the
advent of home shopping, package vehicles are everywhere and traverse
every street in the Borough. The rules remain the same no matter the
location of the delivery.
D. This section
is not only to accommodate the Borough businesses relying on truck
deliveries but also the traveling public and everyone's safety.

A. Definitions. For the purpose of this section, words and terms shall
have the following meanings:
AUXILIARY LANE
The portion of the road adjoining the main traveled portion
of the road, which is used or can be used for the parking of vehicles.
COMMUTER VEHICLE
A motor vehicle parked in a residential area by a person
not a resident of that area.
PROPRIETOR
A person who owns or leases real estate within a residential
area of which he or she is not a resident, but who owns or manages
a business enterprise or professional office maintained at the address.
RESIDENT
A person who owns or leases real property within a residential
area and who maintains either a voting residence or bona fide occupant,
or both, at that address.
RESIDENTIAL AREA
The contiguous area containing public highways or parts of
public highways primarily abutted by residential property or residential
and nonbusiness property (such as schools, parks, places of worship,
hospitals and nursing homes).
TRAVEL PORTION OF ROADWAY
A traffic lane or travel lane for the movement of vehicles
travelling from one destination to another, not including shoulders.
The portion of the road designed for the through movement of vehicles,
exclusive of auxiliary lanes.
B. Assumptions.
(1) The police use the following criteria when making determinations
as to citing or towing vehicles.
(2) At any location, such as parks, playgrounds, roadways, etc., if vehicles
are parked in such a way as to inhibit the even flow of traffic, fire
vehicle, ambulance, or any emergency vehicle cannot easily pass, the
police will take the following actions:
(a)
The police will attempt to notify the violating vehicle owners.
(b)
The police will wait a reasonable amount of time and, if there
is no response, they will ticket the vehicles and notify our towing
contractor to remove the vehicle(s).
(3) In any location in the Borough in which there is a cul-de-sac, the
Public Works Department has nowhere to pile snow or remove it, so
they will use the cul-de-sac for storing the snow. If this poses a
hardship to any resident, they must contact the Public Works Supervisor.
(4) If you live in an area in which parking is prohibited on the street
and you will be having a gathering that will require more parking
than your driveway can accommodate, please contact the police and
advise them that you will have overflow parking on the street. Please
make this notification at least 24 hours prior to the event.
(5) Pertaining to handicapped parking, the Borough finds that handicapped
parking spaces are temporary in nature. As such, may be established
and rescinded by resolution designating spaces as reserved for handicapped
parking. Any person violating this section is guilty of an offense
within Title 75 of the Pennsylvania Vehicle Code and will be charged at District Court.
(6) For a thirty-day period, the police will issue warning notices instead
of fine violations. At the conclusion of the thirty-day grace period,
violations with fines will begin being issued.

A violation of any section of this chapter will result in a
fine of $15. If the fine is paid within five days of the date of issue,
it will be only the $15. After five days from the date of issue, the
fine will increase to $25 and remain that for 60 days of the date
of issue. After the sixty-day period the violation will be filed with
the District Magistrate for court disposition. Note: Once violations
are brought to the District Magistrate level, fees and costs will
be added. The fine can be paid by using the envelope that was left
on the vehicle and depositing it at the Borough Administrative offices
at the Community Center (either by handing it to a staff member or
putting it into the night deposit). Paying by check: Make check payable
to the Borough of Oakdale. Mailing: 104 Seminary Ave., Oakdale, PA
15071. If you desire to appeal the violation, you can submit a letter
of rebuttal with your fine, and the letter will be handled by the
Chief of Police for investigation, disposition and notification.

A. All Borough streets and Borough-owned parking lots shall be reserved
for customer parking/public parking from 7:00 a.m. to 7:00 p.m., Monday
through Saturday.
B. All business owners and employees within the Borough of Oakdale business
district shall park their vehicles in the Rock parking lot.
C. The employees of the Borough are hereby empowered to erect official
signs indicating "Customer Parking" and "No Parking" within the Oakdale
business district pursuant to the above or wherever otherwise authorized
by law.
D. Violation of any provision of this section relating to parking is
a summary offense, and any person, firm or corporation violating such
regulations shall be subject to the following penalties:
(1) Any person, firm or corporation receiving a parking ticket may plead
guilty to the violation indicated thereon by remitting a fine of $5
within three days of the date of the ticket.
(2) If the aforementioned fine is not paid (or postmarked, if remitted
through the mail) within the three-day limit, then the fine for each
outstanding violation shall be $32.50. In addition, the defendant
shall pay costs if the Police Department is required to issue a summons
in order to collect the fine.
E. Modification of business district. The Council of the Borough of
Oakdale is authorized to add or delete streets from the area defined
as the "business district" by resolution of the Borough Council.
F. In order for business to flourish in the Borough, we must make it
easy for the visiting public to park. It is incumbent upon every business
owner to have their employees park in such a way as to give the visiting
public parking space closest to the business. The Borough has the
authority to post "No Parking" or "Customer Parking" signs whenever
it is deemed necessary.

A. The Borough desires to establish criteria and provide a procedure
for its residents to apply for and secure handicapped parking spaces,
pursuant to 75 Pa.C.S.A. § 3354(d) and the Americans With
Disabilities Act of 1990, Pub. L. No. 101-336, 104 Stat. 328 (1990).
B. No person shall park a vehicle at any time in a parking space in
any Borough on-street or off-street parking area reserved for a handicapped
person or a disabled veteran which has been so posted, unless that
person lawfully bears handicapped registration plates or placards
issued by the Pennsylvania Department of Transportation.
C. The Borough Council is hereby authorized to establish and/or designate
parking spaces in any Borough on-street or off-street parking area
as exclusively reserved for parking by a handicapped person or disabled
veteran and to post such spaces accordingly. The establishment, number
and location of such spaces in the Borough's parking areas shall be
at the discretion of the Borough Council.
D. The Council shall not entertain a request to designate a handicap
parking space without a handicap placard or handicapped registration
plate issued by the Pennsylvania Department of Transportation.
E. In the event the applicant does posses a handicapped registration
plate or placard issued by PennDOT, Borough Council can then review
all attendant circumstances and determine if a handicapped parking
space is needed.
F. If there are an inordinate number of requests for handicapped spaces
on one residential block, Council has the obligation to review the
requests and open dialogue with the requesters to ensure the Borough
is doing the right things for the right reasons.

G. The Borough Council finds that handicap parking spaces are temporary
in nature and, as such, may be established and disestablished by a
resolution designating spaces as reserved for handicapped parking.
H. Any person violating this section is guilty of a summary offense
and shall, upon conviction, be sentenced to pay a fine as established
by the Pennsylvania Motor Vehicle Code, 75 Pa.C.S.A. § 101
et seq.
