§ 73-1 Short title.

This article shall be known as and may be cited as the "Dancing Exhibition Ordinance of the Township of Parsippany-Troy Hills."

§ 73-2 Purpose.

This article is enacted to regulate the time, place and manner of dancing exhibitions within the Township of Parsippany-Troy Hills.

§ 73-3 Definitions.

As used in this article, the following terms shall have the meanings indicated:
BOTTOMLESS EXHIBITION
Having the genital area beneath the waist unclothed or clothed by a transparent material or so scantily clad or draped as to appear uncovered.
EXHIBIT or EXHIBITION
To show oneself in any capacity, whether while employed in the performance of work or entertainment or whether simply at leisure.
GO-GO LOUNGE
An establishment permitting a scantily clad person or persons to perform in a suggestive or lascivious, wanton or salacious manner and is held open to the public or to which the public is invited.
OPERATOR
Any proprietor, owner or operator of a business establishment.
TOPLESS EXHIBITION
Having the breasts unclothed or clothed by a transparent material or so scantily clad or draped as to appear uncovered.

§ 73-4 Restrictions.

It shall be unlawful for any person, corporation or association of persons of any kind to permit or employ a person in any place open to the public or to which the public is invited, including alcoholic beverage licensees within the Township of Parsippany-Troy Hills to perform the following:
A. 
Topless or bottomless exhibitions or dancing by a female person or persons.
B. 
Bottomless exhibitions or dancing by a male person or persons.

§ 73-5 Alcoholic beverage licensees.

No licensee shall engage, permit or suffer any person employed by such licensee to perform any topless or bottomless exhibitions in or on any part of the alcoholic beverage licensed premises commonly known as a "go-go" lounge.

§ 73-6 Female exhibition.

It shall be unlawful for any female person to exhibit herself topless or bottomless in any public place or any place open to the public or to which the public is invited within the Township of Parsippany-Troy Hills.

§ 73-7 Male exhibition.

It shall be unlawful for any male person to exhibit himself bottomless in any public place or any place open to the public or to which the public is invited within the Township of Parsippany-Troy Hills.

§ 73-8 Indecent performances prohibited.

It shall be unlawful for any operator to employ, allow, permit or suffer in and upon the premises any person to perform for hire or for the entertainment of patrons any dances, ballet, acrobatics or public performance of any kind which:
A. 
Have as a dominant theme appeal to a prurient interest in sex.
B. 
Are patently offensive in their affront to contemporary local community standards relating to sexual matters.
C. 
When taken as a whole, lack serious artistic value.

§ 73-9 Lewd entertainment prohibited.

It shall be unlawful for any operator to engage in or allow, permit or suffer any person employed to perform dancing or other entertainment in or upon the premises or to carry on any part of such dancing or other entertainment in a lewd, licentious or lascivious manner.

§ 73-10 Indecent exposure by employees.

It shall be unlawful for any operator to employ, allow, permit or suffer any waitress, waiter, bartender, barmaid or any other person employed by the operator for a purpose other than providing entertainment, if such person comes in contact with or is likely to come in contact with the patrons of said establishment, to appear in the presence of such patrons with either both breasts or the lower part of the torso uncovered or so thinly covered or draped so as to appear uncovered.

§ 73-11 Age restrictions.

It shall be unlawful for any operator to employ, allow, permit or use entertainers under the age of 18 years.[1]
