As used in this chapter, the following terms shall have the meanings
indicated:
VILLAGE OFFICER OR EMPLOYEE
An officer or employee of the village, whether paid or unpaid, including
members of any administrative board, commission or other agency thereof. No
person shall be deemed to be a village officer or employee solely by reason
of being a volunteer fireman or civil defense volunteer, except a chief engineer
or assistant chief engineer.
Any village officer or employee, whether paid or unpaid, who participates
in a discussion or gives an official opinion to the Board of Trustees of the
village on any legislation before such Board shall publicly disclose on the
official record the nature and extent of any direct or indirect financial
or other private interest of his in such legislation.
No village officer or employee shall invest or hold any investment,
directly or indirectly, in any financial, business, commercial or other private
transaction which creates a conflict with his official duties.
No village officer or employee shall engage in, solicit, negotiate for
or promise to accept private employment or render services for private interests
when such employment or service creates a conflict with or impairs the proper
discharge of his official duties.
No village officer or employee shall, after the termination of service
or employment with the village, appear before any board or agency of the village
in relation to any case, proceeding or application in which he personally
participated during the period of his service or employment or which was under
his active consideration.
No village officer or employee shall use or attempt to use his official
duties to secure unwarranted privileges or exemptions for himself or others.
Nothing in this Code shall be deemed to bar or prevent the timely filing
by any village officer or employee or any former village officer or employee
of any claim, account, demand or suit against the village or any agency thereof
on behalf of himself or any members of his family arising out of any personal
injury or property damage or any lawful benefit authorized or permitted by
law.
The Mayor of the village shall cause a copy hereof to be distributed
to every officer and employee of the village within 20 days after the adoption
of this Code. Each officer and employee elected or appointed after the adoption
of this chapter shall be furnished a copy upon entering the duties of his
office or employment.
The Board of Trustees of the village may establish a Village Board of
Ethics which shall have all the powers and duties provided by law with respect
to village officers and employees. The members of the Board of Ethics shall
be appointed by the Board of Trustees to serve at the pleasure of the Board
of Trustees. The Board of Ethics shall consist of at least three members,
a majority of whom are not otherwise officers or employees of the village.
Such Board of Ethics shall include at least one member who is an elected or
appointed village officer or employee.
