GENERAL REFERENCES
Riding bicycles on boardwalk — See Ch. 116, § 116-5.
As used in this chapter, the following terms shall have the meanings indicated:
BICYCLE
A device having two wheels with tires, 15 inches or more in diameter, connected by a frame of metal or other material and arranged to be propelled by human power. The provisions of this chapter shall apply only to bicycles as defined herein and to no other vehicles or devices of any kind.
A. 
General. No person shall ride or use a bicycle in the City of Long Branch unless the bicycle has been registered with the Director of the Department of Public Safety or his designee and a license obtained therefrom as herein set forth, provided that any bicycle registered in any municipality in the State of New Jersey need not be registered under this chapter.
B. 
Temporary residents. Summer residents, visitors, transients, vacationers and all other temporary and short-term residents in the city, regardless of their length of stay in the city, shall register their bicycles as herein provided and shall observe all other provisions of this chapter.
C. 
Rental businesses. Any person maintaining, operating, or conducting a business of renting bicycles within the limits of the city shall register all bicycles employed in such rental business.
D. 
Transference of ownership. Any person who purchases a new or used bicycle or to whom ownership of a bicycle is otherwise transferred shall register the bicycle within five days of taking ownership.
A. 
Application procedure. Application for a license plate and registration certificate shall be made to the Director of the Department of Public Safety or his designee upon a form approved by the Director. The license plate and registration certificate shall be issued by the Director or his designee as herein provided for, upon receipt of the application, license fee and proof of ownership of the bicycle.
B. 
Qualifications and requirements. No person shall be issued a license plate and registration certificate until it is found by an examination by the Director of the Department of Public Safety or his designee that the bicycle is in a safe mechanical condition to operate, that the applicant has the ability to operate the bicycle and that he has knowledge of the rules and regulations set forth in this chapter as to the operation of bicycles in the City of Long Branch.
C. 
Term; attachment and inspection of license. Licenses shall run for one year commencing May 1 of each year to April 30 of the next year, and all licenses shall expire on April 30. The license issued by the Director of the Department of Public Safety or his designee shall at all times be attached to the bicycle in a manner prescribed by the Director and, together with the registration certificate issued to the owner, shall be at all times subject to inspection by the Director or his designee.
D. 
Fee. The license fee to be paid for each bicycle registered shall be $1 per year or any part thereof; fees are to be remitted by the Director of the Department of Public Safety or his designee to the City Comptroller. Upon loss of a license plate, and upon satisfactory evidence of the loss, a new license plate shall be issued upon payment of $1.[1]

No person shall willfully, maliciously remove, destroy, mutilate or alter the number of any bicycle frame licensed pursuant to this chapter. No person shall remove, destroy, mutilate or alter any license plate, seal or registration card during the time in which such license plate, seal or registration card is operative, provided that nothing in this chapter shall prohibit the Director of the Department of Public Safety or his designee from marking or stamping on the frames of bicycles on which no serial number can be found or on which such number is illegible for identification purposes. The Director of the Department of Public Safety or his designee may also mark or stamp a number upon the frame of any bicycle registered which shall be the secret number of the Department, if so required in the administration of the provisions of this chapter to prevent bicycle larceny and recover stolen bicycles.

A. 
Every person riding or using a bicycle in the city shall obey all sections of the Motor Vehicle Code of the State of New Jersey, N.J.S.A. 39:1 et seq., which relate to bicycles, and obey all ordinances passed by the city as to the regulation of traffic on stop streets, one-way streets and through streets.
B. 
No person shall ride a bicycle on a sidewalk or a boardwalk unless the sidewalk or boardwalk has been designated for use as a bikeway by the Director of the Department of Public Safety or his designee.
C. 
Unless another penalty is expressly provided by New Jersey statute or this subsection, any person convicted of a violation of this subsection or its supplements and amendments shall be punishable as provided in Chapter 1, General Provisions, Article I.[1]

A. 
In addition to all other penalties for violation of this chapter, the Director of the Department of Public Safety or his designee may seize and impound the bicycle of an offender at the time the police officer charges an offender with a violation. Such seizure and impoundment shall be at the discretion of the police officer at the scene. Whenever any bicycle shall be impounded for violations of the provisions of this chapter, it shall be surrendered at the earliest opportunity to the owner or, in the case of persons under 17 years of age, to their parents or guardian upon payment of an impoundment fee not to exceed $2.
B. 
Where a bicycle has been seized because it has been found in the possession of a person not the legal owner thereof, and the bicycle is not reclaimed by the legal owner thereof or restored to the legal owner thereof, it shall be sold at public auction after the expiration of 60 days or more from the date of seizure. Notice containing a description of the bicycles to be sold at public auction shall be published in the official newspaper of the city at least one week prior to the public auction thereof. Proceeds of such auctions shall be remitted to the comptroller of the city by the Director of the Department of Public Safety or his designee. No impoundment fee or any other fee shall be levied against persons claiming and recovering stolen bicycles which have come into the possession of the Department of Public Safety.
A. 
Any person under the age of 17 years who violates any of the provisions of this chapter shall be, for the first offense, reprimanded in writing by the Director of the Department of Public Safety or his designee, which writing shall be addressed to the parents or guardian of the offender, stating the nature of the violation and warning that a repetition of the violation or any other violation must be prevented by the parents or guardian or the offender's registration shall be suspended for a period of time not to exceed one month at the discretion of the Director of the Department of Public Safety or his designee, and that during that period of time the offender shall not ride his bicycle on the streets of the city.
B. 
Any suspension of an offender's registration certificate beyond the first suspension may be for a period of time up to two months, at the discretion of the Director of the Department of Public Safety or his designee, during which time the offender shall not ride his bicycle on the streets of the city.
C. 
Any person under the age of 17 years who repeatedly violates the provisions of this chapter may, at the discretion of the Director of the Department of Public Safety or of his designee, be penalized by successive suspensions of his registration certificate or by referral as a juvenile complaint to the Juvenile Conference Committee of the City of Long Branch, and ultimately, where deemed necessary, to the Juvenile and Domestic Relations Court of Monmouth County.
