Whenever any words and phrases are used in this chapter, the meaning respectively ascribed to them in Subtitle 1 of Title 39 of the Revised Statutes of New Jersey shall be deemed to apply to such words and phrases used herein.
Whenever certain hours are named in this chapter, they shall mean either Eastern standard time or Eastern daylight saving time, as may be in current use in the City.
A. 
Regulations not exclusive. The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey statute or as hereinafter provided.
B. 
Parking prohibited during state of emergency.
(1) 
Whenever snow has fallen and the accumulation is such that it covers the street or highway, no vehicle shall be parked on any of the streets or parts of streets described in Schedule I (§ 325-25) attached to and made a part of this chapter.
(2) 
The above parking prohibitions shall remain in effect after the snow has ceased until the streets have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic.
(3) 
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary EMERGENCY NO PARKING signs are displayed. The Director of the Office of Emergency Management or, in his absence, his designee is authorized to declare an emergency and to direct the posting of EMERGENCY NO PARKING signs when weather conditions, accidents, fires, public celebrations, etc., dictate or require the avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that EMERGENCY NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.

(4) 
Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any peace officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.
(5) 
The effectiveness of this subsection is contingent upon signs being erected as required by law.
C. 
Parking prohibited at all times on certain streets. No person shall park a vehicle at any time upon any of the streets or parts thereof described in Schedule II (§ 325-26) attached to and made a part of this chapter.
D. 
Parking prohibited during certain hours on certain streets. No person shall park a vehicle between the hours specified in Schedule III of any day, except Sundays and public holidays, upon any of the streets or parts of streets described in Schedule III (§ 325-27) attached to and made a part of this chapter.

E. 
Parking prohibited during certain hours during certain times of the year. No person shall park a vehicle between the hours specified in Schedule IV of any day, except Sundays and public holidays, between such dates specified in Schedule IV, upon any of the streets or parts of streets described in Schedule IV (§ 325-28) attached to and made a part of this chapter.

F. 
Parking prohibited during certain additional hours during certain additional times of the year. No person shall park a vehicle between the hours specified in Schedule IVA of any day, except Sundays and public holidays, upon any of the streets or parts of streets described in Schedule IVA (§ 325-29) attached to and made a part of this chapter.[1]

G. 
Parking time limited on certain streets. No person shall park a vehicle for longer than the time limit shown in Schedule V at any time between the hours listed in Schedule V of any day, except Sundays and public holidays, upon any of the streets or parts of streets described in Schedule V (§ 325-30) attached to and made a part of this chapter.
H. 
Alternate side of the street parking. No person shall park a vehicle between the hours specified in Schedule XIX of any day, except Sundays and public holidays, upon any of the streets or parts of streets described in Schedule XIX (§ 325-45) attached to and made a part of this chapter.

I. 
No stopping or standing. No person shall stop or park or permit his vehicle to stand at locations or on streets set forth in Schedule XIV (§ 325-40) attached to and made a part of this chapter.

J. 
Loading zones. Pursuant to the provisions of N.J.S.A. 39:4-197, the areas described in Schedule XVII (§ 325-43) attached to and made a part of this chapter are hereby designated as loading zones. There shall be no parking in these areas except for the surplus of commercial loading and unloading. LOADING ZONE, NO PARKING signs shall be installed as provided therein.

K. 
Restricted parking.
(1) 
No person, other than those persons who have been issued special vehicle identification cards by the Division of Motor Vehicles, shall be permitted to park a vehicle upon any of the streets or parts of streets described in Schedule XVIII (§ 325-44) attached to and made a part of this chapter. All vehicles in these spaces will park at a forty-five-degree angle.

(2) 
Penalty for restricted parking. Unless otherwise set forth, any person or violator of this section shall be subject to the penalty as provided by N.J.S.A. 39:4-197(3)c.

L. 
Prohibited parking certain vehicles, equipment and trailers.

(1) 
No truck, tow truck, bus, tractor-trailer or trailer body of any kind, vacation home or camper trailer, coach or similar vehicle of any kind, with a manufacturer's gross vehicle weight rating in excess of 8,000 pounds, shall be parked on any street in any zone or any boat or boat trailer of any size shall be parked on any street in any zone between the hours of 8:00 p.m. and 7:00 a.m. The foregoing restrictions shall also apply to the parking of any vehicles, regardless of weight rating, that have roof storage of ladders, scaffolding, other equipment, materials or items which overhang either the front or rear bumper of the vehicle, extending beyond said bumper or bumpers of the vehicle.

(a) 
No person who owns or has possession, custody or control of any semitrailer or trailer of any kind, shall park such a trailer upon any street, roadway or alley within the City; unless such trailer is, at all times while so parked, hitched or attached to a truck or vehicle capable of moving such trailer in a normal manner upon the public streets or roadways.

(2) 
No truck, limousine, recreational vehicle or vehicle, trailer, truck, van, taxi, bus (school or otherwise, tow truck, recreational vehicle with lettering or design showing the name and/or contact information of a commercial service thereon (a "prohibited vehicle") may park on streets within the City between the hours of 8:00 p.m. and 7:00 a.m., seven days a week, without a permit issued in accordance with this chapter. "Commercial vehicle" is defined as any commercial vehicle which is registered or is required to be registered as a commercial vehicle either by the State of New Jersey or the state in which the vehicle is registered. Permits shall be issued by the Director of Public Safety, or their designee, under the following conditions:

(a) 
A resident of the City may apply for and receive a permit allowing the parking of a prohibited vehicle within the City on the following conditions:
[1] 
The vehicle registration and applicant's drivers license must bear the same address within the City of Long Branch under which the permit is to be issued.
[2] 
No more than one permit shall be issued per residence or postal address.
[3]

(3) 
Construction trailers or equipment upon approval of the Chief of Police or his designee may be permitted to be parked on any street in any zone during the construction of the principal structure therein and shall be removed at the completion of the principal structure. The location of the parked trailer or equipment will be coordinated with the Traffic Division and will comply with state and local laws. In the event that a safety problem arises, the trailer or equipment can be required to be relocated or removed from the roadway at any time.

(4) 
This prohibition shall not apply to service vehicles parked during the performance of said services at the location in question. On-call status shall not be considered the performance of a service.

(5) 
Any vehicle, boat, equipment or trailer in violation of this subsection, after being cited, may be impounded by any police officer. The owner shall pay the cost of any towing and storage as set forth in Chapter 316, Towing, § 316-5, Fees and charges.
(6) 
The penalty for violations of this subsection shall be governed by § 325-23.

M. 
Prohibited off-street parking.

(1) 
The parking of vehicles, of any nature, on any off-street property in the City shall be prohibited unless the parking occurs in an area defined pursuant to Code § 345-42, Off-street parking regulations.
(2) 
The enforcing authority for this subsection is granted to the Police Department of the City of Long Branch, the Fire Prevention Bureau and the Zoning Officer.
(3) 
The fine for a violation of this subsection shall be up to $500 per offense. A court appearance shall be required for any summons issued pursuant to this subsection.
N. 
Angled parking. Angled parking shall be permitted on streets as designated in § 325-51, Schedule XXV: Angled Parking, attached hereto and made a part of this chapter. Failure to park in the manner as required by this section may be the subject of a summons issued by the enforcing authority of this chapter with penalties for violations governed by § 325-23.

A. 
The Chief of Police, or his designee, is hereby authorized to suspend parking restrictions temporarily in the City of Long Branch under circumstances, for durations, in areas, and at times as the Director, or his designee, deems, in his discretion, appropriate and in the interests of public safety.
B. 
The suspension of the parking restrictions by the Chief of Police or his designee shall not last for a period of time greater than 72 hours.
C. 
This section shall in no way permit the Chief of Police or his designee to lift, suspend, or in any way modify those parking restrictions governed by Title 39 of the New Jersey Statutes Annotated.

Trucks, buses and other vehicles over the registered gross weight as set out in Schedule VI (§ 325-31) are hereby excluded from all streets in the City of Long Branch, except for the pickup and delivery of materials. The tonnages specified shall in no event be more than four tons registered gross weight.
The streets or parts of streets described in Schedule VII (§ 325-32) attached to and made a part of this chapter are hereby designated as one-way streets in the direction indicated.

Parking, pursuant to N.J.S.A. 39:4-135b, shall be permitted on those streets or parts of streets described in Schedule VIIA (§ 325-33) attached hereto and made a part hereof.
Pursuant to the provisions of N.J.S.A. 39:4-140, the streets or parts of streets described in Schedule VIII (§ 325-34) attached to and made a part of this chapter are hereby designated as through streets. Stop signs shall be installed on the near right side of each street intersecting the through street except where yield right-of-way signs are provided for in the designation.
Pursuant to the provisions of N.J.S.A. 39:4-140, the intersections described in Schedule IX (§ 325-35) attached to and made a part of this chapter are hereby designated as stop intersections. Stop signs shall be installed as provided therein.
Pursuant to the provisions of N.J.S.A. 39:4-140, the intersections described in Schedule X (§ 325-36) attached to and made a part of this chapter are hereby designated as yield intersections. Yield right-of-way signs shall be installed as provided therein.

Signs. Regulatory and warning signs shall be erected and maintained as required by the Director of the Division of Motor Vehicles and as specified in the letter and authorization dated December 16, 1968, from the Traffic Safety Service of the Division of Motor Vehicles.
B. 
Speed limits. The speed limit for both directions of traffic along the streets or parts thereof described in Schedule XIII (§ 325-39) attached to and made a part of this chapter is hereby established at the rate of speed indicated.
C. 
Regulatory and warning signs. Regulatory and warning signs shall be erected and maintained to effect the above-designated speed limits as authorized by the New Jersey Department of Transportation.

Pursuant to the provisions of N.J.S.A. 39:5A-1, providing that the Board of Directors of any corporation or the Board of Trustees of any corporation or other institution of a public or semipublic character not for pecuniary profit incorporation under N.J.S.A. 15A:1-1 et seq. may request that the provisions of N.J.S.A. 39:1-1 et seq. shall be made applicable to the semipublic or private roads, streets, driveways, trails, terraces, bridle paths, parkways, tenants, employees and other roadways open to or used by the public, tenants, employees and the members of such institutions for purposes of vehicular travel by such persons, and not as a matter of public right, the following named entities located in the City of Long Branch have filed a request that the provisions of N.J.S.A. 39:1-1 et seq. shall be made applicable to, and it is hereby ordained that the following shall be made applicable:

(b) 
The parking area on the west side of the Fine Arts Building.
(c) 
The roadway from the south end of the parking area forming a semicircle about the Fine Arts Building ending at the south entrance of said building.
(d) 
The entrances and driveways located at the Monmouth College Police Building.
(e) 
The parking area located south of the Monmouth College Police Building.
C. 
Kossick Way Municipal Parking Lot.

(1) 
Parking in designated areas. All vehicles must park only in designated areas and between the lines provided.
(2) 
Handicapped parking. All stalls shall be 12 feet wide as shown on the attached site plan and signed with R7-8 (Reserved Parking sign and penalty plate), in the designated parking areas for persons who have been issued the handicapped parking permits by the Division of Motor Vehicles.[2]

No person shall park a vehicle at any time upon any of the roadways or grounds of the Board of Education except in designated areas, between the painted lines, and all vehicles so parked shall be properly identified.

A. 
Authority of Mayor.
(1) 
Under and by virtue of N.J.S.A. 40:67-16.9, the Mayor of the City of Long Branch is hereby authorized to provide by regulation for the closing of any street or portion thereof to motor vehicle traffic for any period of time or on any day or days or during specified hours on any day or days whenever he finds that said closing is necessary for the preservation of the public safety, health or welfare or for any such other reason as he may deem necessary.
(2) 
Under and by virtue of N.J.S.A. 40:67-16.9, the Mayor of the City of Long Branch is hereby authorized to provide by regulation for the posting of proper warning signs of such aforesaid closing on any street or portion thereof during the time the same is closed in pursuance thereof.
(3) 
Under and by virtue of N.J.S.A. 40:67-16.9, the Mayor of the City of Long Branch is hereby authorized to promulgate by regulation penalties for violation of this section or any regulation issued thereunder.
B. 
Violation and penalty. Unless another penalty is expressly provided for by New Jersey statute, every person convicted of a violation of a provision of this section, its supplements and amendments, or by regulation issued thereunder, shall become liable to the penalty as stated in § 325-23 of this chapter.

Unless another penalty is expressly provided by New Jersey statute, any person, firm or corporation convicted of a violation of this chapter shall be subject to a penalty of not more than $500 or imprisonment for a term not to exceed 15 days, or both.

A. 
Adoption of the Manual on Uniform Traffic Control Devices for Streets and Highways.
(1) 
The Council hereby finds and declares that problems of traffic control occur when traffic must be moved through or around street construction, maintenance operations and utility work, above- and below-ground, which requires blocking the roadway and obstructing the normal flow of traffic, and that such obstructions are or can become dangerous when not properly controlled. In order to better promote the public health, safety, peace and welfare, it is necessary to establish control and regulations directed to the safe and expeditious movement and to provide safety for the work force performing these operations.
(2) 
The City of Long Branch in the County of Monmouth, State of New Jersey, does hereby adopt the current Manual on Uniform Traffic Control Devices, hereafter known as "MUTCD," except as hereby supplemented and amended, as it controls and regulates wherever construction maintenance, operations or utility work obstructs the normal flow of traffic. A person, contractor or utility who fails to comply with the provisions of MUTCD while performing such work is in violation of this section.
B. 
Preconstruction meeting. It shall be the responsibility of the person, contractor or the case of a public utility as required under the public utility agreement wishing to conduct work on, under or above the roadway to contact the Traffic Bureau of the City of Long Branch Police Department in order to arrange a preconstruction meeting to submit plans for the safe movement of traffic during such period of construction work. Any person, contractor or utility who fails to comply with this section prior to the start of such work or whose plans are not approved by the Traffic Bureau of the Long Branch Police Department is in violation of this section.
C. 
Hazardous conditions. The person, contractor or utility shall provide the Traffic Bureau of the Long Branch Police Department with at least two emergency contact phone numbers to be called in case of emergency problems at the construction or maintenance site prior to the start of any work. If for any reason emergency contact cannot be reached, or if the emergency contact person does not respond to the call from the Police Department to correct a hazardous condition, the City may respond to correct such hazardous conditions. The reasonable fees for such emergency service by the City shall be charged to the person, contractor or utility responsible for such conditions.
D. 
Hours. There shall be no construction, maintenance operations or utility work on any roadway in the City of Long Branch before 9:00 a.m. or after 5:00 p.m. This time limit may be adjusted to permit work prior to 9:00 a.m. or after 5:00 p.m. in the case of an emergency or for the safety and convenience of the general public and the Long Branch Police Department. If it is determined by the officer in charge that the construction or maintenance operations prior to 9:00 a.m. or after 5:00 p.m. would substantially delay traffic or cause a safety or health hazard, the work shall then be permitted only between 9:00 a.m. and 5:00 p.m.
E. 
Road closing and detours. Road closing and/or traffic detours shall not be permitted unless approved by the Long Branch Police Traffic Bureau or, in the case of emergency, the officer in charge of the station house.
F. 
Traffic directors. Traffic directors shall be posted at all construction or maintenance sites when determined to be necessary by the Long Branch Police Department Traffic Bureau or, in case of emergency, the officer in charge of the station house, that the same is necessary to provide for the safe and expeditious movement of traffic.
G. 
Stop work. The Long Branch Police Department Traffic Bureau or, in the case of an emergency, the officer in charge of the station house shall have the authority to stop work, including the removal of equipment and vehicles and stored material within the street, right-of-way backfilling of open excavations and/or other related work, in order to abate any nuisance and/or safety hazard or for any violation of this section.
H. 
Site preparation. It is to be expressly understood that no materials, vehicles or equipment are to be placed in the roadway or sidewalk area until all construction, signs, lights, devices and pavement markings are installed.
I. 
Violations and penalties.
(1) 
Unless another penalty is expressly provided by New Jersey statute, any person, contractor or utility who commits a violation of this section regarding traffic controls for street and highway construction maintenance operations shall, upon conviction thereof, for a first offense pay a fine of not less than $500 nor more than $750 and/or be imprisoned in the county jail for a term not to exceed 90 days.
(2) 
For a second offense, upon conviction thereof, pay a fine for not less than $750 and/or be imprisoned in the county jail for a term not exceeding 90 days.

A. 
Program established.
(1) 
It shall be unlawful to park any motor vehicle without a valid permit as provided for herein on a street marked and designated "Resident Permit Parking Only."

(2) 
The governing body shall determine by ordinance the streets to be designated as "Resident Permit Parking Only."
(3) 
Emergency and public utility vehicles may park within the permit parking area during the time they are rendering service for repairs within the permit parking area.
(4) 
Contractors, service and delivery vehicles bearing the name and address of a commercial business may park without a permit during the time they are rendering service to a residence within the permit parking area.
B. 
Issuance of permits.

(1) 
Residential parking permits shall be issued by the Chief of Police of the City of Long Branch, or his designee, to residents of the City of Long Branch who own or lease one or more passenger motor vehicles.
(2) 
The passenger motor vehicles must be registered to the dwelling unit resident on a street designated as "Resident Permit Parking Only."

(3) 
Applications for resident permit parking under this section shall be made via an online parking management system supplied by the Chief of Police, or his designee, of the City of Long Branch.
(4) 
The design of the permit and its placement on or in the vehicle shall be determined by the Chief of Police, or his designee.
(5) 
The quantity of permits issued for each area will be at the discretion of the Long Branch Police Department. The total quantity of permits issued will exceed the amount of available parking. The purchase of a residential parking permit will not guarantee a space will always be available for all permit holders.
(6) 
Residential parking permits listed in § 325-49 shall be available for sale at a cost of $25 per permit; such permit will be valid for one calendar year and must be renewed annually.
(7) 
Once an application is approved, an area/zone-specific decal will be affixed to the vehicle which is only valid in the specific area/zone for which it is issued.

The locations described in Schedule XXIV (§ 325-50) attached to and made a part of this chapter are hereby designated as handicapped parking zones.

No person shall park a vehicle upon any of the streets or parts thereof listed below except an electric or hybrid vehicle:

251 3rd Avenue (Third Avenue).
