There is hereby established a Board of Assessment Review to consist
of three members to be appointed by the Town Board.
Of the members of the Board of Assessment Review first appointed, one
shall hold office for the term of one year, one for two years and one for
three years from and after his appointment. Their successors shall be appointed
for the term of five years from and after the expiration of the terms of their
predecessors in office.
If a vacancy shall occur on the Board of Assessment Review other than
by expiration of term, such vacancy shall be filled by the Town Board by appointment
for the unexpired term.
The Town Board shall have the power to remove any member of the Board
of Assessment Review for cause and after public hearing.
Public meetings of the Board of Assessment Review shall be held during
the first two weeks of July each year in accordance with the provisions of
§ 1524(2) of the New York State Real Property Tax Law. Legal notice of the time and place of the public meetings of the
Board shall be given during the two-week period preceding such meetings by
publication in the official newspaper of the Town of Orchard Park.
Every rule and regulation, every amendment or appeal thereof and every
order, requirement, decision or determination of the Board of Assessment Review
shall be immediately filed in the office of the Town Clerk and shall be a
public record.
A majority of the members of the Board of Assessment Review shall constitute
a quorum for the transaction of business.
Settlements agreed upon by the taxpayers and the Board shall be in writing
on a form approved by the Board and signed by the parties in interest or their
duly authorized representatives.
