All licenses granted pursuant to the provisions of this article shall be licensed for the calendar year unless otherwise specified, and all fees for such licenses shall be fees imposed for the calendar year unless otherwise specified.
It shall be unlawful for any person or persons, company, partnership or corporation to engage in and carry on, pursue or conduct within the territorial limits of the Township of Saddle Brook, in the County of Bergen, any business, trade, employment, vocation, occupation or purpose hereinafter specified without first obtaining a license from the Township Clerk of the Township of Saddle Brook so to do, and no place, premises or vehicle shall be used or operated for any of the said purposes hereinafter specified unless a license is first had and procured in the manner hereinafter set forth.
All applications for a license shall be made in writing and filed with the Township Clerk. The application shall state the name of the applicant, his address, the nature of the license desired and such facts as the Township Clerk may require. The Township Clerk shall keep a record of all licenses issued by him, which record shall show the date of the issuance, the number of the license, the character of the license, the name and address of the person licensed and the amount of the fee paid. The Township Clerk shall remit all moneys received by him for license fees as herein provided to the Township Treasurer on or before the first day of each month and shall also make a written report to the Township Council for each calendar month, setting forth the number of each kind of license issued and the amount collected and remitted to the Township Treasurer.

The Township Clerk is hereby authorized to approve the granting of permits and licenses in the Township of Saddle Brook which is to be memorialized at the next public meeting of the Township Council. Upon the initial granting of said permit or license, the Township Clerk shall be permitted to issue said permit or license, if the applicant is so entitled, and collect a fee which is to be deposited with the appropriate Township official.
All licenses issued herein shall be displayed either in or on the place or premises affected or upon the vehicle used and operated pursuant to such license and shall be produced and exhibited at any time upon the request of a police officer or any other person.

Nothing herein contained shall require the taking out of a license hereunder to sell the products of the seller's farm located in this state, nor for any carnival, circus, traveling show, exhibition, concert or theatrical performance, either public or private, for which any money is asked or demanded, held by and for a charitable or religious body or any Police or Fire Department or veterans organization.
The word "person" as used herein shall be construed to mean an individual, firm, partnership, corporation, voluntary association or an incorporated association, and the masculine gender shall include the feminine and neuter genders, and the singular number shall include the plural number.

The Township Council of the Township of Saddle Brook reserves the right and power to refuse the granting of any license for any cause not deemed to be for the best interest of the Township and may, in its discretion, revoke any license on five days' notice to the holder thereof, after a hearing before the Township Council for the purpose of revoking the same. No pushcart or park peddler license may be issued during the hours of a parade.
All licenses properly applied for shall be issued by the Township Clerk upon payment of the fee herein fixed; except, however, that when an application is made for a license for live poultry dealers, junk shops and junkyards and in connection with traveling or other shows, circuses, exhibitions, street performances and all street parades in connection therewith, theaters, concert halls, dance halls, pool or billiard parlors, carnivals and all other public places of amusement, the licenses for the same shall not be issued by the Township Clerk until the applications therefor shall first have been referred to the Township Council.
All licenses granted shall apply only to the place or building stated in such application and for all other places or buildings shall be null and void except as hereunder provided, and no more than one license for moving-picture houses shall be issued for every 1,500 of population of said Township as determined by the last federal and state census.
Licenses granted hereunder shall not be transferable, and no license shall apply to any person other than the one named therein.

All licenses heretofore issued for any of the purposes herein specified shall remain valid and effectual until their expiration date, and, if there is no expiration date, said licenses shall expire at the end of the calendar year.
The fee for annual licenses granted after the first day of August in each year shall be one-half ( 1/2) of the amount hereinbefore provided.

A. 
Transient merchants.
(1) 
"Transient merchant" or "vendor" is defined as any person, firm or corporation that engages in the sale of goods, wares or services from public or private premises on a temporary basis and for a temporary period of time.
(2) 
It shall be unlawful for any person, firm or corporation to engage in, carry on or conduct the business of a transient merchant or vendor in the Township of Saddle Brook.
B. 
It shall be unlawful to sell or offer to sell any goods, wares, services or commodities of any kind on any public street or sidewalk in the Township, except that those persons who operate a retail business may, as part of the business, sell or offer to sell goods, wares, services or commodities from the public sidewalk immediately adjoining the premises.
C. 
The payment of the licensing fees provided for in this article shall not apply to charitable, religious or civic organizations; however, those organizations must file a written notice with the Township Clerk's office setting forth the time, place and duration of their activities, even though they are exempt from the payment of a license fee.

Any person violating any provision of this article shall, upon conviction thereof for a first offense, pay a fine not exceeding $100 or in default of payment of such fine be imprisoned in the county jail for a term not exceeding 30 days, in the discretion of the Judge before whom such person may be tried, and for each succeeding similar offense, shall pay a fine not exceeding $200 or be imprisoned in the county jail not exceeding 90 days, or both, as may be fixed by the Judge before whom such person may be tried.
