Any dog which is on any of the streets, alleys or other public grounds in the Borough of West Chester or upon the property of someone other than the owner or custodian of such dog must be on a leash which is attached to the dog by a collar or harness and must be accompanied by and under the control of the owner or custodian at all times.
Any dog running at large in conflict with the provisions of § 37-5 of this article shall be taken by Borough police or the Borough's Dog Catcher to the place designated by the Borough Council as a pound. The Chief of Police or his agent shall cause any dog bearing a proper license tag so seized and detained to be properly kept and fed and shall cause immediate notice, either personal or by registered mail, to be given to the person in whose name the license was procured, or his agent, to claim such dog within 10 days. The owner of the dog so detained shall pay all reasonable expenses incurred by reason of its detention. The rates for charges and expenses shall be determined from time to time by the Borough Council.

If 10 days after obtaining the postal return receipt, such dog or other pet has not been claimed, the Chief of Police of the Borough or his agent or the Borough dog catcher shall dispense of such dog or other pet by sale or by giving it to a humane society or association for the prevention of cruelty to animals. No dog or other pet so caught and detained shall be sold for the purpose of vivisection or research or be conveyed in any manner for these purposes
The provisions of this Article are intended to supplement the duties and responsibilities imposed upon dog owners by the Dog Law of Pennsylvania, Act of 1982, P.L. 784, as amended.[1]
