A. It shall be unlawful for any person, firm or corporation
or any officer or employee thereof to block or cause to be blocked
a continuous three-foot-wide strip for unimpeded pedestrian traffic
in the center portion of a sidewalk of the Borough of West Chester
by the storing or placing of goods, wares or merchandise within that
three-foot-wide traveled section of the paved sidewalk, whether the
same is ordained or unordained, or by the obstruction thereof by trucks
or other vehicles being backed or driven on or across such sidewalks
for the purpose of loading or unloading goods, wares or merchandise
of any kind or description whatsoever.
B. It shall be unlawful for any person to discharge or
cause to be discharged any stormwater, roof runoff, sump pump discharge
or waters onto any sidewalk where such discharge is determined to
be a hazard by the Director of Public Works and/or his or her designee.
Upon such determination by the Borough's Director of Public Works
and/or his or her designee, the Borough's Director of Public Works
and/or his or her designee shall provide written notice to such person
to take such steps as are necessary to abate the hazard. Exceptions
to the requirements of this section may be permitted by the Public
Works Committee of the Borough Council due to unique physical constraints.

Any person who violates or permits the violation
of any provision of this chapter shall, upon conviction thereof in
a summary proceeding brought before a District Justice, be guilty
of a summary offense and shall be subject to the payment of a fine
of not less than $25 and not more than $1,000, plus the costs of prosecution.
Upon default of payment thereof, the defendant may be sentenced to
imprisonment in the county prison for a period of not more than 30
days. Each section or provision of this chapter that is violated shall
constitute a separate offense, and each day or portion thereof in
which a violation of this chapter is found to exist shall constitute
a separate offense, each of which violations shall be punishable by
a separate fine imposed by the District Justice of not less than $25
and not more than $1,000, plus the costs of prosecution, and, upon
default of payment thereof, the defendant may be sentenced to imprisonment
in the county prison for a term not more than 30 days.
