Every nonresidential structure (including every structure which is a combination of residential and nonresidential) and the premises on which it is situated shall comply with the provisions of this article. No license or permit or other certification of compliance with this code shall constitute a defense against any violation of any other local ordinance applicable to any structure or premises.
Owners of nonresidential structures and premises shall have the general duties outlined herein for the maintenance of the premises, and no such owner shall be relieved from any such responsibility hereunder by reason of the fact that an agent, employee, occupant or other person shall have similar responsibilities or shall have failed to report any violation, nor shall any such owner be relieved of any responsibility by the terms or provisions of any lease, contract or agreement.
A. 
All structures and premises subject to this chapter shall be kept free of all the following conditions:
(1) 
Brush, weeds, broken glass, stumps, roots, obnoxious growth, filth, garbage, trash, refuse and debris.
(2) 
Dead and dying trees, limbs or other natural growths which, by reason of rotting or deteriorating conditions or storm damage and weathering, constitute a hazard to persons in the vicinity thereof. Trees shall be kept pruned and trimmed to prevent such conditions.
(3) 
Loose and overhanging objects and accumulations of ice and snow which, by reasons of location above ground level, constitute a danger of falling on persons in the vicinity thereof.
(4) 
Holes, excavations, breaks, projections, obstructions, ice conditions and other safety hazards of walks, driveways, parking lots, parking areas and other parts of the premises which are accessible to and used by persons on the premises. All such holes and excavations shall be filled and repaired, walks and steps replaced and other conditions removed where necessary to eliminate safety hazards or unsanitary conditions.
B. 
Adequate runoff drains shall be provided and maintained to eliminate any recurrent or excessive accumulation of stormwater.
C. 
Sources of infestation or potential infestation by rodents, mosquitoes, flies, bees, wasps and other harmful or annoying insects shall be promptly removed.
D. 
The exterior of every structure or accessory structure, including fences, shall be maintained in good repair, and all surfaces thereof shall be kept painted and finished where necessary for purposes of preservation and appearance. The same shall be maintained free of broken glass, loose shingles, crumbling stone or brick, excessive peeling of paint, graffiti or other conditions reflecting weathering or deterioration or inadequate maintenance to the end that the property itself may be preserved and safety and fire hazards eliminated and adjoining properties in the neighborhood protected from blighting influences.
E. 
There shall not be stored or used at a location visible from the sidewalk, streets or other public areas equipment and materials relating to commercial or industrial uses unless permitted under the zoning ordinances of the Borough of Madison[1] for the particular premises.

F. 
Natural vegetation, landscaping, lawns, hedges and bushes shall not be allowed to become overgrown and unsightly where exposed to public view and where the same constitutes a blighting factor depreciating adjoining property.
G. 
All parts of the premises shall be kept in a clean and sanitary condition, free of nuisances and free from health, safety and fire hazards.
