The responsibilities of the Zoning Board of Appeals and the Planning Board of the Town of Milan have increased and broadened to the extent that members of said Boards will be assisted in the performance of their duties by a program of education covering all phases of their functions. Attendance at training sessions should be a requirement and qualification for the holding of the respective offices. As a result, the Town hereby establishes provisions to implement said education and training program.
A. 
The Town Board shall, by resolution hereby authorized, establish a program and course of instruction and education and shall amend, change and modify the same, again by resolution, to attain and maintain a level of proficiency in the functions of and performance of duty by all members of the Zoning Board of Appeals and the Planning Board of the Town of Milan.
B. 
Said program shall be conducted annually between January 1 and June 30 of each year at times and places to be established by the Town Board and shall encompass, but not limited to, any and all changes and updating in the interpretation and application of Chapter 200, Zoning, and Chapter 177, Subdivision of Land, of the Code of the Town of Milan and all rules and regulations applicable thereto, as well as the laws of the State of New York.
The Town Board is hereby authorized to secure and employ such experts and qualified personnel to instruct all of said members, the expense of which shall be borne totally by the Town.
A. 
Any person acting as a member of the Zoning Board of Appeals or the Planning Board of the Town of Milan shall attend said program annually, and, upon successful completion of said program according to the criteria and standards established by the Town Board, said Town Board shall issue a certificate of completion as a required qualification for said person to continue in office.
B. 
In the event that any member fails to obtain the issuance of a certificate of completion annually, such failure in and of itself shall constitute and result in a disqualification of said member to continue to act as such member and shall constitute cause for removal from office after a public hearing, and upon such removal, the office of such member shall thereupon be considered and shall be and become vacant upon entry of the facts upon the minutes of the Town Board at a regular meeting, and the Town Board shall thereafter have authority to appoint another person to fill said vacancy.
C. 
For reasons determined by the Town Board to be appropriate under all attending circumstances, said Town Board shall have the power to waive any of the provisions of the foregoing Subsection B and to append any conditions and terms to said waiver in order to permit and allow any member to attend an alternate program.
