The individuals and/or firms named on Schedule A,[1] attached hereto and incorporated herein by reference thereto, are hereby designated by the Board of Supervisors of Bern Township as authorized Sewage Enforcement Officers to administer, on behalf of the Township, the provisions of the aforesaid Act and rules and regulations adopted pursuant thereto.

Where a firm is so designated, only the person or persons so designated on Schedule A who shall be certified "qualified" pursuant to the provisions of the Act, shall perform any services on behalf of the Township as said Sewage Enforcement Officer.
The Board of Supervisors of the Township of Bern hereby adopts as the application fee for services to be performed by any Sewage Enforcement Officer, the actual charge of such Sewage Enforcement Officer for the services to be performed; provided, however, that such application fee charges shall not exceed the schedule as set forth on Schedule B,[1] attached hereto and incorporated herein by reference thereto.

The selection of the particular Sewage Enforcement Officer shall be in the sole discretion of the applicant.
Any such application fees and charges shall be payable to the Township of Bern and collected by and turned over to the Township by such Sewage Enforcement Officer, each of which is hereby designated as the Township's duly authorized agent to receive said fees and charges which shall be collected prior to the issuance of a permit by the Sewage Enforcement Officer.
The aforesaid designation of Sewage Enforcement Officers and schedules of fees as shown on Schedules A and B respectively shall replace any Sewage Enforcement Officers and fees presently established by the Bern Township Board of Supervisors.

The office of Township Manager is hereby created by the Board of Supervisors of the Township of Bern, Berks County, Pennsylvania.
The Board of Supervisors of Bern Township shall appoint, by a majority vote of all of its members, one person to fill the office of the Township Manager, who shall serve for an indefinite term until resignation or removal or until his successor is appointed and qualified. In the case of a vacancy, the Board of Supervisors of said Township shall fill said office by a majority vote of all of its members.
The Manager need not be a resident of the Township of Bern at the time of his appointment or thereafter.
The salary of the Township Manager and all other benefits of employment shall be fixed by resolution at the time of appointment and from time to time thereafter but must be payable in accordance with established Township payroll practices.
Before entering upon his duties, the Manager shall give a bond to the Township with a bonding company as surety, to be approved by the Board of Supervisors upon the advice of the Solicitor, in a sum to be determined by the Board of Supervisors, conditioned upon faithful performance of his duties. The premium for the said bond shall be paid by the Township.
A. 
Township Manager shall be the Chief Administrative Officer of the Township and he shall be responsible to the Board of Supervisors as a whole for the proper and efficient administration of the affairs of the Township of Bern. His powers and duties shall relate to the general management of all Township business not expressly by statute imposed or conferred upon other Township officers.
B. 
Subject to recall by ordinance, the powers and duties of the Township Manager shall include the following:
(1) 
Supervision and responsibility for activities of all municipal departments, except those the supervision of which shall not have been delegated to the Manager by the Board of Supervisors.
(2) 
Recommend to the Board of Supervisors the hiring of any employee and, when necessary for the good of the Township, suspend any employee under his supervision, subject, however, to review by the Board of Supervisors at its next meeting; provided, however, that full-time police officers and persons covered by civil service laws, if any, shall be hired, suspended or discharged in accordance with such provisions; and provided, further, that the Township Manager shall report, at the next meeting thereafter of the Board of Supervisors, any action taken by authority of this subsection.
(3) 
He shall prepare and submit to the Board of Supervisors, before November 1 of each year or on such alternate dates as the Board of Supervisors shall determine, a budget for the next fiscal year and an explanatory budget message. In preparing the budget, the Manager, or an officer designated by him, shall obtain from the head of each department, agency, board, or office, estimates of revenues and expenditures and other supporting data as he requests. The Manager shall review such estimates and may revise them before submitting the budget to the Board of Supervisors.
(4) 
He shall be responsible for the administration of the budget after its adoption by the Board of Supervisors of Bern Township.
(5) 
The Township Manager shall hold such other municipal offices or head one or more of the municipal departments as the Board of Supervisors of Bern Township may from time to time direct, subject to any applicable statutory restrictions regarding incompatible offices.
(6) 
He shall attend all meetings of the Board of Supervisors and of its committees with the right to take part in the discussion and he shall receive notice of all special meetings of the Board of Supervisors and of its committees.
(7) 
He shall prepare, or direct the preparation of, the agenda for each meeting of the Board of Supervisors and supply facts pertinent thereto.
(8) 
He shall keep the Board of Supervisors informed as to the conduct of Township affairs, submit periodic reports on the conditions of the Township's finance and such other reports as the Board of Supervisors request and make such recommendations to the Board of Supervisors as he deems necessary.
(9) 
He shall submit to the Board of Supervisors as soon as possible after the close of the fiscal year, a complete report on the financial and administrative activities of the Township for the preceding year.
(10) 
He shall see that the provisions of all franchises, leases, permits and privileges granted by the Township are observed. He may employ, by and with the approval of the Board of Supervisors, experts and consultants to perform work and to advise in connection with any of the functions of the Board of Supervisors of Bern Township which are within his duties.
(11) 
He shall attend to the letting of contracts in due form of law and shall supervise the performance and faithful execution of the same except insofar as such duties are expressly imposed upon some other Township officer by statute.
(12) 
He shall see that all money owed the Township is promptly paid and that proper proceedings are taken for the security and collection of all Township claims.
(13) 
He shall be the purchasing officer of the Township and he shall purchase, in accordance with the provisions of the Second Class Township Code and other applicable laws, all supplies and equipment for the various agencies, boards, departments and other offices of the Township. He shall keep an account of all purchases and shall, from time to time, or when directed by the Board of Supervisors, make a full written report thereof. He shall also issue rules and regulations, subject to the approval of the Board of Supervisors, governing the requisition and purchasing of all municipal supplies and equipment.
(14) 
All complaints regarding services or personnel of the Township of Bern shall be referred to the office of the Township Manager. He or an officer designated by him shall investigate and dispose of such complaints, and the Township Manager shall report thereon to the Board of Supervisors.
If the Township Manager becomes ill or needs to be absent from the Township, the Board of Supervisors shall designate one qualified member of the Township staff who shall perform the duties of the Manager during his absence or disability. The person so designated shall not perform such duties for a period longer than two weeks without redesignation by the Board of Supervisors, which may revoke such designation at any time during any such period of two weeks.
The Board of Supervisors (or a committee thereof) shall, no less than annually, review and discuss with the Township Manager his or her job performance. The Board of Supervisors shall retain the right to impose such discipline as may be warranted by the Township Manager's conduct, up to and including suspension or termination. The Township Manager shall, however, be subject to removal at any time, with or without cause, by a majority vote of all the members of the Board of Supervisors of said Township. At least 30 days before such removal becomes effective, the Board of Supervisors of Bern Township shall furnish the Manager with a written statement setting forth its intention to remove him and the reasons, if any, therefor.
Other than for the purpose of inquiry, the Board of Supervisors, any of its members or any of its committees or members of committees shall deal with the administrative service solely through the Township Manager, and neither the Board of Supervisors nor any of its members nor any of the Board of Supervisors' committees or committee members shall give orders, publicly or privately, to any subordinate of the Township Manager.
The Board of Supervisors reserves the right at any time, by ordinance, to amend or otherwise modify or repeal this article.
