For the purpose of this Code, and in the interpretation
and application of all other ordinances heretofore or hereafter adopted,
except as the context may otherwise require, the following terms shall
have the meanings indicated:
DEPARTMENT
An organizational unit of the government established or designated
by ordinance or this Code as a department, together with any agency
or instrumentality of the government assigned to such organizational
unit by the Township Council.
LICENSED
Licensed in accordance with the appropriate section or chapter
of this Code.
MONTH
A calendar month unless otherwise specifically provided.
ORDINANCE
Any act of local legislation heretofore or hereafter adopted,
and including this Code, so long as it is adopted by the procedure
required for the adoption of an ordinance and so long as it remains
in force and effect pursuant to law.
PERSON
Any individuals, natural persons, partnerships, joint ventures,
societies, associations, clubs, trustees, trusts, corporations or
unincorporated groups or any officers, agents, employees, servants,
factors or any kind of personal representatives of any thereof in
any capacity, acting either for himself or for any other person, under
either personal appointment or pursuant to law.
STREET
Includes a street, avenue, road, alley, lane, highway, boulevard,
concourse, driveway, culvert, sidewalk and crosswalk and every class
of road, square, place or municipal parking field used by the general
public.
TOWNSHIP
The Township of Howell in the County of Monmouth and State
of New Jersey.
YEAR
A calendar year unless otherwise specifically provided.
For the purpose of this Code and any other ordinances
heretofore or hereafter adopted, except as the context may otherwise
require:
A. The present tense includes the past and future tenses,
and the future the present.
B. The masculine gender includes the feminine and neuter.
C. The singular number includes the plural and the plural
the singular.
D. "Shall" is mandatory and "may" is permissive.
E. The time within which an act is to be done shall be
computed by excluding the first and including the last day, and if
the last day is a Sunday, a legal holiday, or a day on which the offices
of the Township are closed, that day shall be excluded.
F. "Writing" and "written" shall include printing, typewriting
and any other mode of communication using paper or similar material
which is in general use, as well as legible handwriting.
G. Whenever a specific time is used in this Code, it
shall mean the prevailing and established time in effect in the State
of New Jersey during any day in any year.
H. Any citation of a statute, law or ordinance contained
in this Code shall be deemed to refer to such statute, law or ordinance
as amended, whether or not such designation is included in the citation.

A. Chapter title. Chapter
2 herein shall be known and may be cited as the "Administrative Code of the Township of Howell" and is herein referred to as the "Administrative Code" or "code."
B. Definitions. For the purposes of the Administrative
Code and in the interpretation and application of all other ordinances
and resolutions heretofore or hereafter adopted, except as the context
may otherwise require, the following terms shall have the meanings
indicated:
DEPARTMENT
An organizational unit or group of organizational units of the Township government established or designated as a department by Chapter
2.
DEPARTMENT HEAD
The administrative head of a department, regardless of his
title.
GENERAL LAW
Any law or provision of law, not inconsistent with the ordinances
heretofore or hereafter enacted, which is, by its terms, applicable
or available to all municipalities and the following additional laws,
whether or not such additional laws are so applicable or available
to all municipalities: legislation relating to taxation, local courts,
education, health, public authorities serving more than one municipality
and municipalities in unsound financial condition.
GOVERNING BODY
The Township Council created and constituted pursuant to
the Charter.
MANAGER
The Township Manager appointed and serving pursuant to the
Charter or Administrative Code.
ORDINANCE
Any and all ordinances of the Township of Howell in force
and effect on January 1, 1993, and thereafter.
TOWNSHIP or MUNICIPALITY
The Township of Howell in the County of Monmouth, State of
New Jersey, as governed by the provisions of the Charter.
C. Construction. For the purposes of the Administrative
Code and any other ordinances heretofore or hereafter adopted, except
as the context may otherwise require:
(1) The masculine gender includes the feminine and neuter.
(2) "Writing" and "written" include printing, typewriting,
stencil, duplicating and any other legible mode of reproducing words
or figures on paper or paper-like material which is in general use.
(3) Any reference to the office of the Township Administrator,
unless specifically defined to the contrary, shall mean the Manager
as defined herein.
(4) Any reference to the body "Township Committee," unless
specifically defined to the contrary, shall mean the governing body
as defined herein.
D. Publication and filing. The Clerk of the Township
of Howell, pursuant to law, shall cause a copy of the adopting ordinance
for the Administrative Code for the organization and administration
of the government of the Township of Howell to be published in the
manner required. Sufficient copies of both the Revised General Ordinances
of the Township of Howell, New Jersey, and this section, "An Ordinance
To Adopt an Administrative Code for the Organization and Administration
of the Government of the Township Of Howell, in the County of Monmouth
Pursuant to the Council - Manager Form, Plan A of the Optional Municipal
Charter Law N.J.S.A. 40:69A-81 et seq. as Amended" shall be maintained
in the office of the Clerk for inspection by the public at all times
during regular office hours. The enactment and publication of the
adopting ordinance, coupled with the availability of copies of the
Revised General Ordinances of the Township of Howell, New Jersey,
and this section, as stated aforementioned in this subsection, shall
be deemed, held and considered to be due and legal publication of
all provisions of said ordinance.
E. Code book to be kept up-to-date.
(1) It shall be the duty of the Township Clerk, or someone
authorized or directed by the Clerk, to keep up-to-date the certified
copy of the book containing the Revised General Ordinances of the
Township of Howell, New Jersey, required to be filed in his office
for the use of the public.
(2) All changes in said codified ordinances and all ordinances
adopted subsequent to the effective date of this Code which shall
be adopted specifically as part of the codified ordinances shall,
when finally adopted, be inserted therein by reference.
F. Copy of Code on file. A copy of this Code shall be
filed in the office of the Township Clerk and shall remain there for
use and examination by the public, and, if the adopting ordinance
is adopted, such copy shall be certified by the Township Clerk by
impressing thereon the seal of the Township as provided by law, and
such certified copies shall remain on file in the office of the Township
Clerk to be made available to persons desiring to examine the same
during all times that the subject Code is in effect.
G. Seal. The existing Township Seal shall be continued.
