No person shall own and operate any taxicab or limousine within the
Township of Middle unless licensed pursuant to this chapter.
A taxicab owner's license shall entitle the taxicab therein described
to be operated by the owner in the Township of Middle or by a driver duly
licensed by the State of New Jersey until the license either expires or is
surrendered, suspended or revoked and shall not be transferable.
Any licenses issued pursuant to the terms of this chapter shall expire
at 12:00 midnight of the 31st day of December of the year in which they were
issued unless sooner surrendered, suspended or revoked.
All applications for issuance or renewal of any license shall be made
in writing to the Township Committee on prescribed forms. Each applicant for
a license shall supply the information requested on the application and file
the same, together with the proper fee hereinafter fixed, at least two weeks
before the application shall be acted upon.
Every applicant for a license shall submit to the Township Clerk the
proper insurance policy or certificate in lieu thereof as required by the
Revised Statutes of the State of New Jersey.
The Township Committee may, in its discretion, refuse to issue or renew
or may, after notice and hearing, revoke or suspend:
A. Any license if the applicant or licensee has been once
convicted of a crime in this or any other jurisdiction or convicted of being
a disorderly person or of a violation of Title 39, Motor Vehicles and Traffic
Regulation, of the Revised Statutes of New Jersey or who violates any provision
of this chapter or has any judgment unsatisfied of record against him arising
out of an automobile accident or who is an alien citizen of any nation between
which and the United States of America a state of war exists or who has made
false answers in his application for such license or any renewal thereof or
who has failed or fails to render reasonably prompt safe and adequate taxicab
service or who has not complied fully with all requirements of this chapter
for such license.
B. Any taxicab owner's license if the motor vehicle licensed
or to be licensed by reason of unsafe or unsanitary condition, is dangerous
to the safety or health of the occupants or others or if the policy of insurance
required by N.J.S.A. 48:16-3 has lapsed or such coverage is not maintained
at all times.
No person shall park any taxicab on any of the streets or highways of
the Township of Middle at any time except at such place or places as the Township
Committee may from time to time designate as municipal taxi stands.
Any person or persons who shall violate any of the provisions of this
chapter shall, upon conviction thereof, be subject to one or more of the following:
a fine not exceeding $1,000 or imprisonment in the county jail for a term
not exceeding 90 days or a period of community service not to exceed 90 days,
in the discretion of the Judge by whom such person is convicted.
