It shall be the duty and responsibility of the Director of Buildings and Inspections, the Code Enforcement Officer, and/or any other authorized Village employee, as designated by the Village Manager, to enforce the provisions of this code as herein provided.
A. 
Alterations or repairs, other than increasing the height or area of a structure, may be made to any structure without requiring the existing structure to comply with all the requirements of the code for new construction, provided that such new construction conforms to that required by this code. Alterations or repairs shall not cause an existing structure to become unsafe or adversely affect the performance of the building.
B. 
Alterations or repairs to an existing structure which are nonstructural and do not adversely affect any structural member or any part of the structure having a required fire-resistance rating may be made with the same materials of which the structure is constructed.
All materials, equipment and devices approved for use by the Code Official shall be constructed and installed in accordance with such approval.
When there are practical difficulties involved in carrying out structural or mechanical provisions of this code or of any approved rule, the Code Official may vary or modify such provision upon application of the owner or the owner's representative, provided that the spirit and intent of the law shall be observed and public welfare and safety assured.
The application for modification and the final decision of the Code Official shall be in writing and shall be officially recorded in the permanent records of the Department.
The provisions of this code are not intended to prevent the use of any material or method of construction not specifically prescribed by this code, provided that any such alternative has been approved. The Code Official may approve any such alternative, provided that the Code Official finds that the proposed design is satisfactory and complies with the intent of the provisions of this code and that the material, method or work offered is, for the purpose intended, at least the equivalent of that prescribed in this code in quality, strength, effectiveness, fire resistance, durability and safety.
The Code Official shall require that sufficient technical data be submitted to substantiate the proposed use of any material or assembly, and if it is determined that the evidence submitted is satisfactory proof of performance for the use intended, the Code Official may approve its use subject to the requirements of this code. The costs of all tests, reports and investigations required under these provisions shall be paid by the applicant.

The Code Official shall use the information contained in the Uniform Construction Code of the State of New Jersey and regulations adopted thereunder to assist in the application of the provisions of this code to existing buildings.
