There is hereby created and established a Citizens Advisory Council
for Community Development, hereinafter referred to as "CAC," to make recommendations
to the Town Board of the Town of Union regarding the planning, development,
monitoring, coordination and evaluation of a comprehensive community development
program pursuant to and in accordance with Title I of the Housing and Community
Development Act of 1974, as amended (hereinafter referred to as the "Act"),
and in accordance with the interest and needs of the residents of the Town
of Union.
The CAC shall be composed of seven members, each of whom shall have
one vote. The members shall be appointed by the Town Board as follows:
A. Two members from the Village of Endicott.
B. Two members from the Village of Johnson City.
C. Three members from the part-Town area of the Town of
Union outside the incorporated areas of the Town of Union.
The term of office for each CAC member shall be as follows:
A. The first two members appointed shall hold office for
a term of one year.
B. The second members appointed shall hold office for a
term of two years.
C. The third members appointed shall hold office for a term
of three years.
D. The successors of all initial members shall be appointed
for full terms of three years.
In the event that a vacancy occurs in the membership of the CAC for any reason, the Town Board shall appoint another person to fill said vacancy in conformance with §
12-17 of this article.
The CAC shall constitute the official citizen participation structure
for community development in the Town of Union. The following shall govern
the activities of the CAC:
A. The CAC shall recommend plans and proposals to the Town
Board for review, amendment and approval. Such plans and proposals must be
approved by the majority of the CAC at a regular or special meeting.
B. The CAC may make recommendations to the Town Board in
connection with the implementation of the Town's community development
program as approved by the Town Board of the Town of Union.
C. The CAC shall meet annually. Said meeting will be open
to the public and held at the Town Office Building.
D. A three-day written notice shall be sent to each CAC
member before any CAC meeting is held indicating the time and place of the
meeting.
E. Four members of the CAC shall constitute a quorum, which
must be present in order to conduct an official CAC meeting.
F. The CAC shall have authority to promulgate additional
rules of order and operating procedures which are not inconsistent with this
article.
G. The Chairman of the CAC shall be selected by the Town
Board and will serve as the official spokesman of the CAC.
The CAC, in its decisionmaking process, will consider requests, proposals,
comments and other citizen input regarding the Town's community development
program. The CAC will make timely responses to the specific requests of citizens.
The Act provides that no part of its citizen participation requirements
shall be construed to restrict the responsibility and authority of the Town
of Union for the development of its community development block grant application
and the execution of its community development program. Accordingly, the citizen
participation requirements of the Act or this article do not include concurrence
by any person or group involved in the citizen participation process in making
final determinations concerning the findings and content of the Town's
application or program. The sole responsibility and authority to make such
final determinations rest exclusively with the Town Board of the Town of Union.
