There is hereby created a capital improvement district in those areas
of the Town outside the incorporated villages for the purpose of providing
certain capital improvements such as sidewalks, curbs and gutters, and stormwater
sewers, and the charge for said improvements as hereinafter set forth shall
be known as a part-Town charge to be levied only against those in areas outside
of the incorporated villages.

The Town Board shall have the authority to construct sidewalks in any
areas in said capital improvement district, but sidewalks may be constructed
only after a recommendation has been made for the construction of the same
by a vote of the School Board, which recommendation shall be forwarded to
the Town Board, and the Town Board shall have the right to accept, reject
or amend said recommendation. In the event that said sidewalks are constructed,
the cost of constructing the same shall be borne 100% by the Town and become
a part-Town charge.
The Town Board shall have the authority to reconstruct and repair any
existing sidewalks, curbs and gutters that are in need of repair, and the
charge of said reconstruction or repair work shall be borne 100% by the Town
and become a part-Town charge.
The Town Board shall have the authority to construct stormwater sewers
in any areas where the same are required and this shall be determined by a
comprehensive stormwater study, and the cost of constructing the same shall
be borne 100% by the Town and shall become a part-Town charge.

A. On petition of the property owners of at least 1/2 of
the front footage of the street area to be served, the Town Board shall have
authority to construct curbs and gutters, and the cost of constructing such
curbs and gutters will be defrayed by the Town to the extent of 50% of the
total of such costs and shall become a part-Town charge.
B. The Town Board shall have the authority
to set up the necessary procedures for initiating the construction of said
curbs and gutters by adopting rules and regulations for such procedures by
resolution of the Town Board, and said rules and regulations shall have the
full force and effect of law.
