The Town Board, acting under the authority set
forth in the Town Law, § 64, Subdivision 21-a, does hereby
establish a Department of Public Works for the Town of Union and does
hereby authorize the appointment of a Commissioner of Public Works,
who shall be the administrative head of said Department.
The Commissioner of Public Works shall be charged
with the responsibility of managing and directing the Public Works
Department, which will consist of those functions and personnel of
the Highway Department, Buildings and Grounds Department, Sewer Department,
Services Department, Parks and Recreation Department, Permits and
Ordinances Department and Engineering Department.
The Commissioner of Public Works shall have the following duties.
The Commissioner shall:
A. Recommend
to the Town Board competent, qualified employees for the divisions
under his jurisdiction and shall have the authority to recommend and/or
unilaterally implement hiring, dismissal, suspension and disciplinary
action for all employees in the divisions under his control, according
to civil service regulations and existing employee contracts, and
shall designate himself or some other Town employee to fill vacancies
or absences on a temporary basis.
B. Designate
himself or some other Town employee to perform the duties of any position
in said divisions under his control which is vacant or which lacks
administration due to the absence or disability of the incumbent.
C. Prepare
and present to the Town Board of the Town of Union an annual report
of the affairs of said Department of Public Works and such other reports
as the Town Board shall require.
D. Prepare
the budget estimates for the Department of Public Works for submission
to the budget officer.
E. Be
responsible for overall planning with the county, state and federal
grant and aid and planning programs.
The Commissioner of Public Works shall have the following powers.
The Commissioner shall:
A. Assign,
transfer, hire and/or terminate any of the employees in any of the
divisions under his control, including assigning any of said employees
to any division or branch thereof requiring services appropriate to
the classification of the employee so assigned.
B. Draw
up such rules and regulations as he shall deem necessary or expedient
for the conduct of the various divisions under his control and present
said rules and regulations to the Town Board.
C. Either
by himself or by any person designated by him for that purpose, investigate
and examine or inquire into the affairs or operations of any divisions
under his jurisdiction.
D. Have
such other powers and duties as may be delegated to him from time
to time by resolution of the Town Board of the Town of Union, Broome
County, New York.
E. Designate
and/or appoint Deputy Commissioners who will have the authority to
supervise their respective departments and to otherwise act for, and
in the place of, the Commissioner of Public Works with the same power
and authority of the Commissioner of Public Works as it pertains to
each of their respective departments, which said designates and/or
appointments shall be approved effective upon notice to the Town Board.
The designations and/or appointments by the Commissioner of Public
Works as provided herein are "at will" only and may be terminated
at any time, with or without cause, by the Commissioner of Public
Works.
