As used in this chapter, the following terms shall have the meanings
indicated:
PERSON
Any individual, partnership, association, corporation or other legal
entity.
SELF-SERVICE GASOLINE PUMPS
A gasoline pump or similar device used with the dispensing of gasoline
which is designed for use and operation by the customer-motorist rather than
by an attendant or other person employed or authorized by the owner or operator
of the service station.

The construction, assembly, maintenance, use or operation of self-service
gasoline pumps is permitted at any service station or other location where
gasoline is dispensed and/or sold within the Borough of Morrisville. Where
gasoline is sold at retail, the use and operation of self-service gasoline
pumps shall be subject to the following conditions:
A. There must be at least one full-service, attendant-operated
gasoline pump for each self-service pump on the premises.
B. An attendant must be made available at all times during
business hours to render assistance at all pumps, both full-serve and self-serve,
and to otherwise comply with the applicable provisions of the Americans With
Disabilities Act.
C. An emergency shutoff switch must be located at or near
each island containing self-service gasoline pumps.
D. A sign or signs must be conspicuously posted at or near
each island containing self-service gasoline pumps which warns customer-motorists
to refrain from the following activities while using said pumps:
(3) Leaving vehicle engine running; and
(4) Dispensing gasoline into glass container.
E. No self-service gasoline pump in the Borough of Morrisville
shall be equipped with a hold-open nozzle which would enable a customer-motorist
to leave the point of refueling while the gasoline is being dispensed.
This chapter shall be applicable to, and enforceable against the owner
of any property upon which self-service gasoline pumps are located, and in
addition thereto, any lessee, tenant or operator of any such facility.

Any person, firm or corporation who shall violate any provision of this
chapter shall, upon conviction thereof, be sentenced to pay a fine of not
more than $300, together with costs of prosecution, or to imprisonment for
a term not to exceed 30 days.
