herein.

A. All commercial and residential properties are subject to annual fees
as follows:
(1) Each residential dwelling unit, including, but not limited to, residential
dwelling units within a commercial property (i.e., duplex): $285.
(2) Each business within a commercial property except as provided in the following Subsection
A(3): $590.
(3) Apartments having five or more dwelling units and businesses may arrange for private collection in accordance with §
360-40 of this article. Each business and each dwelling unit which utilizes private collection shall pay a nonuser sanitation administrative fee to the Borough for the administration of the refuse/recyclable collection program and the community services provided to or by the Borough in the amount of: $58.
B. The fees due for collection and disposal of refuse and recyclables
shall be billed annually and may be paid in quarterly installments
not later than February 15, May 15, August 15, and November 15. Any
account in arrears more than two quarters shall be subject to a delinquent
fee assessment of 30% of the amount owed and may be turned over to
a collector of accounts to pursue collection.
Apartments having five or more dwelling units
and businesses may arrange for private refuse collection. If such
option is chosen, a letter from the owner of the property, accompanied
by an invoice from the collector, must be submitted to the Borough
prior to the start of private collection. All other owners must have
their refuse collected by the contractor for the Borough.
The fees due for the collection and recyclables
shall be paid by the titled record owner of the property. The fees
shall be billed annually and may be paid quarterly.
No use and occupancy permit shall be issued
for any property unless the refuse disposal fees are currently paid.
Occupancy permits may be revoked for accounts which become 12 months
or more in arrears for charges subsequent to the date of this article.
The Borough reserves the right to stop service
to the property for accounts that are delinquent more than four months
without prior notice to the owner, which shall be followed by citation
to the owner for failing to provide refuse collection. Stoppage of
service shall be in addition to the right of the Borough to proceed
for the collection of such unpaid charges by action of assumpsit,
by municipal lien, nonissuance of a certificate of occupancy, revocation
of a certificate of occupancy and all other methods provided by law
for the collection.
Any person, firm or corporation violating any
of the provisions of this article shall, upon conviction therefor,
be sentenced to pay a fine of not more than $600 and costs of prosecution
and, in default of payment of such fine and costs, to imprisonment
for not more than 30 days; provided, each day's violation of any of
the provisions of this article shall constitute a separate offense.
