No person owning, keeping or harboring any dog
shall suffer or permit it to run at large upon the public streets
or in any public park or in any public building or in any other public
place within the municipal limits of the Township of Brick.
No person owning, keeping or harboring any dog
shall suffer or permit it to be upon the public streets or in any
of the public places of the Township of Brick unless such dog is accompanied
by a person and is securely confined and controlled by an adequate
leash not more than six feet long.

It shall be deemed unlawful and a public nuisance for there to be kept or maintained five or more dogs or cats or a combination of dogs or cats of five or more in or upon any residentially zoned property in the Township of Brick. This section shall not, however, be applicable to a litter of pups or kittens kept or maintained in or upon any such property within six calendar months of birth or to any feral cat colony designated in accordance with Article
XI of this chapter. Any owner or occupant of such residentially zoned property wherein five or more dogs or cats or combination thereof is kept shall be deemed to have violated this section.

No person owning or having the care, custody
or control of any dog shall permit such dog to soil, defile or defecate
upon any sidewalk or street or upon any public property or in or upon
the property of persons other than the owner or person having the
care, custody or control of such dog. If a dog should defecate upon
any sidewalk, street, public property or property of persons other
than the owner or person having the care, custody or control of such
dog, the owner or person having the care, custody or control of such
dog shall be responsible for the removal of such defecation from such
property and shall properly dispose of the same.
No person owning, keeping, harboring or having
control or custody of any dog shall suffer or permit it to go upon
private property which is not that of the owner, without the consent
and permission of the owner, occupant or lessee thereof, within said
Township.

Any person or persons who shall violate any provision of this chapter shall be subject to the penalties as provided in Chapter
1, §
1-15, General penalty, for each offense. Where the Township has contracted with any agency or other entity to carry out animal control on behalf of the Township, any employee of such agency or entity may issue summonses for violations of this article.
