A. 
There will continue to be a Department of Public Works in the Borough ("Department"), headed by the Superintendent of Public Works ("Superintendent") and the Director of Public Works ("Director"). The Superintendent and the Director will be appointed by the Mayor, with the advice and consent of the Council.
B. 
The term of office of Superintendent shall be three years. Tenure will be granted to a person holding the position of Superintendent continuously for five years or more, during good behavior and efficiency, and the Superintendent may not be removed therefrom for political or other reasons except for good cause, upon written charges filed with the Municipal Clerk and after a public, fair, and impartial hearing before the Mayor and Council. Vacancies occurring in the office of Superintendent will be filled in the same manner for the unexpired term only.
C. 
The Director will be appointed to a five-year term. Vacancies will be filled in the same manner as stated above, but for the unexpired term only.

A. 
Under the supervision and direction of the Superintendent and the Director, the Department will:
(1) 
Have charge of all public works within the Borough, including roads, streets, sidewalks, curbing, sewage and drainage systems, highways, public parks, and public places.
(2) 
See that any sewage and drainage systems of the Borough are properly flushed from time to time and that they are kept free from obstructions.
(3) 
Carry out and enforce any provision of this Code or other ordinance of the Borough concerning sewers, storm drains, and street maintenance.
(4) 
Remove or cause to be removed all obstructions or encumbrances upon any streets, avenues, roads, highways, public parks, and public places in the Borough.
B. 
The Superintendent and Director will advise the Chairman of the Public Works Committee of the Borough Council of all necessary repairs to be made to public roads in the Borough and see that repairs are carried out when authorized.
C. 
The Superintendent will perform all duties required by statute for those acting as Public Works Manager and "Municipal Superintendent of Public Works," and will maintain in effect all required permits and approvals.
D. 
The Director will manage the day-to-day operations of the Department, and will perform other supervisory duties assigned to him or her by the Mayor and Council. The Director will keep all required books and records and will and maintain accurate accounts of all moneys expended and of all persons employed in the Department, indicating the time of employment and nature of the work performed and the duration of the work. The Director also will furnish a monthly report to the Mayor and Council in the form they prescribe, which will describe all of the activities of the Department during the preceding month. The Superintendent and the Director may not expend any moneys of the Borough or to obligate the Borough for the expenditure of any moneys without prior written authorization of the Mayor and Council.
E. 
The Director will have the power to recommend to the Mayor and Council the hiring of all necessary laborers and other employees to carry out the work and duties assigned to the Department by his Code or any other ordinance of the Borough.

In addition to the powers, functions, and duties specified in § 54-2, and such other duties as may from time to time be prescribed by law or ordinance, the Director will perform the duties of Dog Warden of the Borough, and in addition to any other reports which he or she is required to make, shall make a separate monthly report to the Mayor and Council concerning his or her activities as Dog Warden during the preceding month.
