As used in this chapter, the following terms shall have the meanings
indicated:
HANDICAPPED PERSON
A person who has been issued a special vehicle identification card
by the Division of Motor Vehicles pursuant to provisions of N.J.S.A. 39:4-205
when using a motor vehicle on which is displayed a certificate for which a
special vehicle identification card has been issued pursuant to N.J.S.A. 39:4-206.
PARKING
The standing or waiting of a vehicle not actually engaged in receiving
or discharging passengers or merchandise unless in obedience to traffic regulations
or traffic signs or signals.
PUBLIC BUILDINGS
Any building, structure, facility or complex used by the general
public.
Parking spaces for handicapped persons shall be constructed according
to the following guidelines:
A. Within 90 days subsequent to the adoption of this chapter,
any owner of a public building within the Borough of Norwood shall provide
no less than one handicapped parking space for the first 15 spaces of public
parking available to it and one more for each additional 30 spaces.
B. The handicapped parking spaces shall be conveniently
located adjacent to the public building entrance. Determination of said location
shall be made by the Code Enforcement Officer.
C. Each space or group of spaces shall be identified with
a clearly visible sign displaying the international symbol of the handicapped
with the wording "Handicapped Parking Only - Special Vehicle Identification
Required." The center of each parking space shall have painted thereon the
symbol for the handicapped.
D. Each parking space shall be 12 feet wide to allow room
for persons in wheelchairs or on braces or crutches to get in or out of either
side of an automobile. The parking space shall be located on a level, paved
surface suitable for wheeling and walking.
E. Any parking facility with less than 10 existing parking
spaces shall be exempt from the provisions of this chapter.
No persons shall park a vehicle in any parking space designated and
marked as being set aside for the physically handicapped in any parking facility
unless the operator of the vehicle is the holder of an identification card
issued pursuant to N.J.S.A. 39:4-205, and said operator's vehicle shall
have affixed thereto an identification certificate or marker issued by the
Director of the New Jersey Division of Motor Vehicles.

A. Failure to provide parking spaces. Any property owner
or occupant failing to provide parking spaces in accordance with the terms
of this chapter and N.J.S.A. 39:4-207.9 shall be liable for a penalty of not
less than $200 or more than $500, and up to 90 days of community service on
the terms and in the form as the court shall deem appropriate, or any combination
thereof.
B. Operators of motor vehicles. Any operator of any motor
vehicle, which does not bear a special vehicle identification certificate
located in accordance with N.J.S.A. 39:4-204 et seq. and N.J.S.A. 39:4-197.5,
who parks the motor vehicle in a space reserved as provided by this chapter
shall be subject to a fine of $250 for the first offense, and for subsequent
offenses, a fine of at least $250, and up to 90 days of community service
on the terms and in the form as the court shall deem appropriate, or any combination
thereof.
