[Adopted as Sec. 14-1 of the Revised General Ordinances]
Pursuant to an Act of the Legislature of the State of New Jersey approved April 23, 1946, constituting Chapter 123 of the Laws of 1946 (hereinafter with the acts amendatory thereof or supplemental thereto referred to as the "Act"[1]), a sewerage district (hereinafter referred to as the "Sewer District") was established by resolution of the Board of Chosen Freeholders of the County of Bergen, New Jersey, adopted February 19, 1947. Pursuant to the Act, the Bergen County Sewer Authority (hereinafter referred to as the "Authority") was erected for the Sewer District and is a body politic and corporate with perpetual succession as a government instrumentality. Further, pursuant to the Act, an agreement with the Authority for the construction by the Authority of the Northern Valley Extension and for the disposal of sewage arising within or collected or caused by the Boroughs of Closter, Demarest, Harrington Park, Haworth, Northvale and Norwood and the Township of Riverdale, in the County of Bergen, State of New Jersey (hereinafter referred to as the "Northern Valley municipalities"), has been submitted to the Northern Valley municipalities, which agreement is more particularly set forth in § 189-3. It appears after due consideration that it is in the best interest of the Borough of Norwood to enter into such agreement.

The Mayor and Borough Council has ascertained and does hereby determine that it is situate within the Sewer District of the Authority, that upon completion of the Northern Valley Extension the Borough can thereby advantageously use the facilities, existing and proposed, of the district sewer system of the Authority and that it will be economically and in other respects advantageous to have sewage and other wastes collected, treated and disposed of by the Authority on and pursuant to the terms of the agreement authorized by this article.
The Borough shall enter into an agreement with the Authority providing for and relating to the collection, treatment and disposal of sewage and other wastes and the cost and expense thereof and for the construction of the Northern Valley Extension on the terms and conditions and substantially in the forms set forth in this article, and the Mayor shall be and is authorized and directed on behalf of the Borough to execute the agreement under the Corporate Seal of the Borough which shall be affixed and attested by the Borough Clerk and to deliver the same.
The agreement shall be in substantially the following form, and the terms and conditions thereof are hereby approved and specifically agreed to.[1]
