It is hereby determined, declared and found that the Borough constitutes
a seashore resort with parts thereof constituting an amusement or entertainment
area according to the customary understanding of the terms in the community
and which parts thereof are more particularly described as that area east
of Ocean Avenue at the point of intersection of Ocean Avenue and Fourth Avenue
and extending northwardly to the most northerly boundary line of the Borough.
It shall be unlawful for any person to own or operate within the Borough
any amusement games, as the terms are defined by the Amusement Games Licensing
Law (Chapter 109, P.L. 1959), whether the games are of skill or chance, or both, and whether
the games are to be played and operated with or without numbers, names, figures
or symbols, without first obtaining a license from the Borough Council. The
license shall be issued pursuant and subject to the provisions of the Amusement
Games Licensing Law (Chapter 109, P.L. 1959).
Each applicant for a license shall file with the Borough Clerk a written
application in such form as prescribed by and in accordance with the Amusement
Games Licensing Law and the rules and regulations promulgated by the Amusement
Games Control Commissioner of the State of New Jersey.
The fees for the category and certification of licenses to be issued
hereunder, which fees shall accompany the application for license, shall be
as established by statute.
If a licensee violates any of the provisions of this chapter or the
Amusement Games Licensing Law or the rules and regulations promulgated by
the State Amusement Games Control Commissioner or the terms of such license,
the licensee shall be a disorderly person and, if convicted as such, shall,
in addition to any other penalties which may be imposed, forfeit his license.

Games of chance are authorized to be conducted on the first day of the
week, commonly known and designated as "Sunday," in accordance with the provisions
of N.J.S.A. 5:8-31 and N.J.S.A. 5:8-58, such games as may be permitted by
N.J.S.A. 5:8-24 et seq. and N.J.S.A. 5:8-50 et seq., and in accordance with
the ordinances of the Borough shall be permitted on Sunday, provided a license
is issued and further provided that all legal requirements authorizing the
issuance of such license have been fully complied with.
