Each employee of the City of Brigantine shall
receive such compensation as is approved by the Council, as set forth
in the annual Salary Ordinance of the City of Brigantine.
Part-time employment shall be approved by the
Manager or by supervisors appointed under the Manager.

Each employee shall be entitled to earn such
vacation, personal days off and sick-leave credits as are granted
to employees of any collective bargaining unit over which or in which
such employee serves. Should such employee not be a member of any
such bargaining unit, the general rules and regulations promulgated
by the Manager, reported to the City Council for its advice and consent,
where applicable, and kept on file with the City Clerk, shall control
the benefits received by such individuals; or the conditions of employment
for any other individual shall be approved by contracts for such purpose
as are negotiated by the Manager and presented to the Council for
approval.
A. All full-time managerial employees, including but
not limited to the City Manager, Deputy City Manager, Chief Financial
Officer, City Clerk, Deputy City Clerk, Administrator of the Court,
Deputy Administrator of the Court, Comptroller, Personnel Officer,
Purchasing Agent, Director of Public Safety, Chiefs of Police, Fire
and Beach Patrol, Superintendent and Supervisors of Public Works and
the Construction Official, shall receive such compensation, credits,
and benefits as are set forth in the rules and regulations relative
to such classes of employees as are promulgated by the Manager, reported
to the City Council for its advice and consent, where applicable,
and kept on file with the City Clerk. Of those specifically mentioned
in the previous sentence, the City Manager, Deputy City Manager, City
Clerk, Director of Public Safety, Chiefs of Police, Fire and Beach
Patrol, Superintendent of Public Works and Construction Official shall
be subject to N.J.S.A. 40A:9-1.3 and be bona fide residents of this
City.

B. All full-time and part-time employees of the City
of Brigantine shall perform their duties under the supervision of
the City Manager or the Council, as provided by law, and all departments
and employees thereof shall have such further duties, functions and
services as shall be required under the supervision, order and direction
of the Manager or of the Council, as the case may be.
C. All part-time employees or advisors of the City of
Brigantine shall perform their duties under the supervision of the
City Manager, except for those specific employees who report only
to the Council, as is set forth in this Administrative Code, and shall
have such duties, functions and services as shall be required under
the supervision, order and direction of the Manager or the Council,
as the case may be.

As soon as is practicable after the adoption
of this chapter, the City Manager shall, with the advice and consent
of the Council, where applicable, prepare general administrative rules
and regulations concerning the departments and employees of the City,
which said rules and regulations shall include but not be limited
to provisions governing the following:
A. The classification of all City employees at the department
level or below, based on the duties, authority and responsibility
of each position, with adequate provision for job classification and
reclassification of any position whenever warranted by changed circumstances.
B. The policies and procedures regulating reduction in
force and removal for cause.
C. The policies and procedures regulating promotion and
the right to transfer among available positions within the City.
D. The hours of work, attendance regulations and provisions
for vacation and sick leave, including accumulations thereof and the
rights of surrender upon termination of employment or from time to
time.
E. The policies and procedures governing persons holding
temporary, provisional and probationary appointments.
F. The policies and procedures regarding in-service training,
attainment of necessary licensure or required education.
G. Grievance procedures, including hearings for the resolution
of such grievances and appeals therefrom.
H. The manner of hiring vacancies to positions, including
the manner of advertising for receipt of applications for positions,
the manner of review and evaluation of applicants, the manner of testing
for any position for which a formal test shall be administered and
the manner of keeping lists of applicants and eligible persons on
such lists.
I. The application of any residency requirement to a
particular position, as such may be allowed or required by law or
by the job.
J. The manner of acceptance of applications for retirement
and the manner of payment or allowance of any terminal leave.
There is hereby established an Ethics Board,
which shall consist of five members, to be appointed by the City Council.
Each member shall be a resident of the City of Brigantine, and none
shall be an employee or officer of the City. The Ethics Board shall
choose from its members a Chairperson.
