The following definitions shall have the following meanings in this
article:
ROLLER SKATES
A pair of devices worn on the feet with a set of wheels attached,
regardless of the number or placement of those wheels, and used to glide or
propel the user over the ground.
SCOOTER
A device propelled by muscular power which consists of a footboard
between end wheels and is controlled by an upright steering handle attached
to the front wheel.
SKATEBOARD
A piece of wood, fiberglass or other rigid material, mounted on skate
wheels and propelled by muscular power.
Any person under 14 years of age shall not operate by roller skates,
skateboards or scooters along any roadways of the City of Brigantine or on
public property within the City of Brigantine under municipal jurisdiction
unless that person is wearing a properly fitted and fastened helmet which
meets the standards of the American National Standards Institute, the Snell
Memorial Foundation's 1990 Standard for Protective Headgear for Use in Bicycling,
the American Society for Testing and Materials Standard or other such standard,
as appropriate.
To the extent that any motor vehicle statute or other state law or regulation
exists concerning the operation of roller skates, skateboards or scooters,
said laws and regulations will remain in full force and effect and the requirements
of this article will be in addition to any requirements of said statutes or
regulations. To the extent that this article is contrary to any such statute
or regulation or any amendment thereto, said state statute or regulation shall
take precedence and control over this article and this article does not absolve
any individual from any of the requirements of any such statute or regulation.
A person who violates the provision of this article by failure to wear
an approved helmet shall be warned of the violation by the enforcing official.
The parent or legal guardian of the violator may be fined a maximum of $25
for a first offense and a maximum of $100 for any subsequent offense. However,
the penalties provided under the provisions of this article for failure to
wear an approved helmet may be waived if the parent or legal guardian of the
violator provides suitable proof that an approved helmet or appropriate personal
protection equipment has been purchased since the violation occurred.
