No person shall water-ski, aquaplane or ride in or on any similar contrivance
or operate a motorboat towing such person on the waters lying within the City
of Brigantine between the hours of sunset and sunrise.
No person shall tow another person on water skis or aquaplane or any
similar contrivance on the waters lying within the City of Brigantine, unless
there is a second person in the boat whose duty it shall be to tend the water-skier
or aquaplane rider.
No person shall operate a motorboat in waters, lying within the City
of Brigantine within 100 feet of any wharf, pier, dock, bulkhead, swimming
area, other craft or person in the water except when docking or leaving a
dock or except under circumstances that such motorboat cannot keep said distance,
in which event such motorboat must reduce its speed to a minimum consonant
with the safety of other persons, craft and property.
No racing of motorboats shall be permitted in any waters lying within
the City of Brigantine except in the case of races sponsored by an organized
yacht or boating club and sanctioned by the governing body of the City.
The speed of motorboats shall at all times be regulated so as to avoid
danger or injury to all manner of craft, whether floating or moored, anchored
or underway, or to piers, wharfs, docks, bulkheads or other waterfront construction,
either directly or by the effect of the wash or wave raised by such motorboat
through its speed or otherwise.
No motorboat shall be operated in a reckless manner. "Reckless operation"
shall include operating such boat in any manner which unnecessarily interferes
with the free and proper use of waters lying within the City of Brigantine,
or which endangers other craft therein or the life or limb of any person upon
such other craft or in the water.
For the purposes of this article, the following terms shall have the
meanings indicated:
MOTORBOAT
Any vessel, boat or craft temporarily or permanently equipped with
a motor or any other means of propulsion except sails or muscular power.
The Harbormasters, the Brigantine Police Department and the Brigantine
auxiliary police shall have the power to enforce the provisions of this article,
to serve and execute process upon any person violating any of the provisions
hereof and to arrest without warrant any person violating any of the provisions
hereof, provided that the offense for which the arrest is made has been committed
in the presence of the arresting officer.

The Municipal Court shall have jurisdiction over any offense committed
under this article. Any person convicted of a violation hereof shall be punishable
by a fine not to exceed $1,000 or by imprisonment not to exceed 90 days.
