Feeding of foxes and raccoons is prohibited.
The feeding of seagulls, pigeons and any and all other wild animals
within the City of Brigantine is hereby strictly prohibited if such
feeding will cause a nuisance.
The trapping of foxes, raccoons, seagulls, pigeons
and other wild animals is hereby strictly prohibited within the City
of Brigantine except by the Animal Control Warden with prior knowledge
and approval of the City Manager of the City of Brigantine.
This article shall govern all areas within the
City of Brigantine with the exclusion of the City of Brigantine North
End Natural Area which is owned by the State of New Jersey. Any trapping
and/or feeding policies concerning such area shall be established
by the appropriate officials of the State of New Jersey, and the City
will take any and all actions necessary regarding the same pursuant
to a license agreement signed between said City and the State of New
Jersey, Department of Environmental Protection.
Notwithstanding anything to the contrary contained
herein, the appropriate state officials of the Department of Environmental
Protection Division of Fish, Game and Wildlife shall be allowed to
conduct any such trapping and/or feeding activities in the City of
Brigantine of wild animals, such as foxes, raccoons, seagulls and
pigeons, but must first inform the City Council of the City of Brigantine
and receive approval from said Council for the same prior to conducting
any such activities.
New Jersey Statutes Annotated, Title 23, entitled
"Fish and Game, Wild Birds and Animals," shall remain in full force
and effect, and if any provision contained therein or regulations
promulgated pursuant thereto are in conflict with this article, said
statutes and regulations shall be given precedence. Further, any conditions
contained in said Title 23 and any and all regulations promulgated
pursuant thereto must be complied with whether set forth in this article
or otherwise.
Any person who violates this article may be
subject to a fine of up to $1,000, imprisonment for up to 90 days
and/or community service for up to 90 days in the discretion of the
Municipal Court Judge.
