Sand is hereby declared to be a nuisance on land or on any lot or lots situate in Brigantine.

A. 
The Building Inspector is hereby designated as the officer having charge of abating any such nuisance, and he is hereby authorized to take such action as may be reasonable and necessary to abate any such nuisance. The Building Inspector is authorized to order the removal of sand from private property.
B. 
For taking such action, he shall be entitled to a fee as set forth in Chapter 210, Mercantile Businesses, Article II, Fees Schedule, which shall be deemed to be a part of the cost and expense of the abating of the nuisance.

Upon the making of a report by the Building Inspector, and the approval, filing and recording thereof as provided by law, the cost and expense of the abating of the nuisance, including all legal expenses, shall be a lien on the land or the lot or lots whereon the nuisance is abated.
