The burying of bushes, logs, branches, foliage or any other vegetable matter, within the limits of the City of Brigantine, is declared to be a nuisance and is prohibited.
A. 
The Building Inspector is hereby designated as the officer having charge of abating any such nuisance, and he is hereby authorized to take such action as may be reasonable and necessary to abate such nuisance.
B. 
For taking such action, he should be entitled to a fee as set forth in Chapter 210, Mercantile Businesses, Article II, Fees Schedule, which shall be deemed to be part of the cost and expense of the abating of the nuisance.

Upon the making of a written report by the Building Inspector, and the approval, filing and recording thereof as provided by law, the cost and expense of abating the nuisance shall be a lien on the land or the lot or lots wherein the nuisance is abated.

Anyone violating the provisions of this article and creating or maintaining upon lands or lot or lots such nuisance shall, upon conviction thereof, be fined a sum not more than $1,000 or be imprisoned for not more than 90 days, or both.
Nothing contained herein shall be construed to prohibit the burial of vegetable matter or any other refuse in any area specifically designated for disposal of such matter by the City.
