There is established an Elected Officials Compensation Commission, which
shall establish the salaries of all local elected officials.
A.
Said Commission shall consist of seven registered elector
members, who shall be appointed by the Mayor subject to confirmation by a
majority of the members serving on the City Council. No member, employee or
member of the immediate family of a member of the legislative, judicial or
executive branch of any level of government shall be eligible to be a member
of the Commission. All appointments to the Commission shall be for a term
of seven years.
B.
The terms of the first members of said Commission shall
be as follows: one member for one year, one member for two years, one member
for three years, one member for four years, one member for five years, one
member for six years and one member for seven years.
C.
All first members shall be appointed within 30 days after
the effective date of this chapter. Thereafter members shall be appointed
before October 1 of the year of the appointment. If any member shall subsequently
become disqualified, he or she shall immediately cease to be a member. All
vacancies to the Commission shall be filled for the remainder of the unexpired
term in the same manner as the other members were appointed.
A.
Immediately after appointment, said Commission shall
meet and organize, electing one of its members Chair. The Commission shall
meet for not more than 15 days in the year 1974 and every odd-numbered year
thereafter. The Commission shall make its determination of salaries within
45 calendar days of its first meeting. A majority of the members of the Commission
shall constitute a quorum for conducting business. The members shall receive
no compensation but shall be entitled to reimbursement of their actual and
necessary expenses incurred in the performance of their duties. The Commission
shall determine salaries of local elected officials, which determinations
shall be the salaries unless rejected by resolution of 2/3 of the members
elected to and serving on the City Council.
B.
Salaries as determined shall be filed with the City Clerk
and shall become effective 30 days after said filing unless rejected by the
aforereferenced resolution of the City Council. In the event that the City
Council rejects the salaries determined by the Commission, the existing salaries
shall prevail. The expense allowance for reimbursement paid to elected officials
in addition to salary shall be for expenses incurred in the course of city
business and accounted for to the city.

One year following the effective date of this chapter, the procedure
for establishing the compensation of elected officials may be changed by Charter
amendment revision.
A petition for a referendum may be filed with the City Clerk within
60 days after the effective date of this chapter. The referendum petition
must be signed by at least 5% of the registered electors of the city on the
effective date of this chapter, or in the alternative, the petition may be
filed in accordance with the procedure provided in the City Charter.[1] In the event that a valid referendum petition is filed, an election
shall be conducted in the same manner as an election on a Charter amendment.
If a petition for referendum is filed, the salaries as determined by the Commission
shall not be effective until the ordinance has been approved by the electors.
