On and after the effective date of this article,
the City Council shall not approve, or signify its approval, of the
issuance of any additional Michigan Liquor Control Commission licenses
governing the sale of alcoholic beverages by the glass upon the licensed
premises within the City if the issuance of said licenses by the Michigan
Liquor Control Commission would increase the number of such licenses
beyond 22. In taking into consideration the number of licenses already
issued, there shall be included Class C licenses, Class B licenses,
hotel licenses and tavern and special licenses; provided, however,
that the applicant may file the necessary petitions with the Council
requesting that the question of whether or not such license should
be issued be placed upon the ballot in the manner provided by law
for referendums. Upon the receipt of the necessary petitions in proper
form, the matter shall be referred to the people of the City for an
election on such question.
It is not the intent of this article to place
any prohibition upon the reclassification of existing licenses by
the Michigan Liquor Control Commission.
