A.
All open burning, such as burning weeds, brush, garbage,
etc., shall be prohibited, except that burning under special conditions may
be permitted, provided that such operations do not create a nuisance or hazard
to health and that consideration shall be given to local weather conditions
and related factors so as to avoid causing any nuisance or hazard to health,
as follows:

Campfires and fires used for outdoor cooking and other
recreational purposes or ceremonial occasions may be allowed.
B.
Any officer of the Fire Department or the Police Department,
when made aware of any violation or complaint on burning, may order the extinguishment
of any such fire or may proceed to have it extinguished by the Fire Department.

C.
Any person burning shall be responsible for all damages
caused by the fire so originated by him, her or them and shall be liable to
the City for all costs which may be incurred in calling the Fire Department
to extinguish such fire.

D.
Any person openly burning under this chapter must be
a minimum of 18 years old and shall be in attendance at the fire or burning
at all times.

E.
All open burning shall require a continuous water source,
for example, a garden hose, to be located within five feet of the burning
site, fireplace, pit, chiminea or other apparatus in which the fire is contained.

F.
Any fire pit, chiminea, barrel, fireplace, or other apparatus
or structure used to burn shall not be in excess of three feet in diameter.

Any violation of § 94-1 shall constitute a misdemeanor and shall be punishable, upon conviction, by a fine not to exceed $500 or 93 days imprisonment, or both.
