For the purpose of this article, the following
terms shall have the meanings indicated:
OPEN CONTAINER
A container shall be considered to be open when:

A.
Its top or cork has been removed.
B.
The container itself is not full, indicating
that its contents have been consumed or removed.
C.
In the case of a metal container or can, the
same has been opened in any way which allows the alcohol to be consumed.
None of the foregoing provisions shall apply
to any park, public picnic area, land or building owned or occupied
by any federal, state, county or municipal government when the consumption
of alcoholic beverages at an occasion or event held by a bona fide
nonprofit organization or other group is specifically permitted by
resolution of the Township of Hillside, nor shall any of the provisions
of this article apply where the authority of the New Jersey Division
of Alcoholic Beverage Control and/or the Hillside Alcoholic Beverage
Control Board to issue temporary licenses for the consumption of alcoholic
beverages has been exercised, pursuant to law.

Any person who violates any provision of this
article shall be subject to a fine not exceeding $1,000; imprisonment
for a term not exceeding 90 days; and/or a period of community service
not exceeding 90 days at the discretion of the court.
