The office of Township Manager is hereby created by the Township of West Brandywine.
The Manager shall be appointed for an indefinite term by a majority of all members of the Board. The Manager shall serve at the pleasure of the Board and may be removed from office at any time by a majority vote of its members.
The Manager shall be chosen on the basis of executive/administrative abilities and personal qualities associated with the duties of the office as herein outlined.
The Manager shall give a bond in an amount fixed by the Board by ordinance to the Township of West Brandywine as surety. This bond shall be conditioned upon honest and faithful performance of his duties. The bond will be obtained from a reputable firm and the premium for said surety shall be paid by the Township of West Brandywine. The initial bond shall be in the sum as set forth by resolution of the Board of Supervisors.
The salary of the Township Manager shall be set at the time of his/her employment and may be adjusted from time to time by resolution duly adopted by the Board.
A. 
The Manager shall be the Chief Administrative Officer and Chief Executive Officer of the Township. He/she shall be responsible to the Board, as a whole, for the proper, efficient and economical administration of the affairs of the Township. He/she shall not create Township policy, but shall see to the faithful and objective implementation of Board policy and decisions. The Manager shall conduct himself/herself at all times with complete fidelity and in a way that will reflect credit upon, and benefit to, the Township of West Brandywine, its citizens and its government as a whole. The powers and duties of administration of Township business as outlined in this chapter, and amendments or directives related thereto, shall be vested in the Manager unless expressly imposed or conferred by statute upon other Township Officers.
B. 
Subject to recall by the Board, the powers and duties of the Township Manager shall be as follows:
(1) 
He/she shall, in accordance with Board policy and direction, supervise and be responsible for the activities of all municipal departments. This is not to infer complete control over the day-to-day operations of municipal departments; said control shall remain with the respective department head of each department.
(2) 
He/she shall, subject to ratification by the Board of Supervisors and all applicable statutes, rules, regulations or collective bargaining agreements, hire and when deemed necessary, suspend, demote or discharge any employee under his/her supervision, with the exception of a department head (Director of Public Works, Chief of Police), who may only be hired, suspended, demoted or discharged by the Board of Supervisors.
(3) 
He/she shall prepare, with assistance from the Township Treasurer, not less than 45 days before the close of each fiscal year, a budget for the next fiscal year, including an explanatory budget message. In preparing the budget, the Manager, or an officer designated by him/her, shall obtain from the head of each department, agency of the Board, or any qualified officer thereof, estimates of revenues and expenditures and such other supporting data as he/she requires.
(4) 
He/she shall be responsible for the administration of the budget after its adoption by the Board.
(5) 
He/she shall, in conjunction with the preparation of the yearly budget, develop long-range fiscal plans for the municipality. Such plans to be presented yearly to the Board for its review and adoption.
(6) 
He/she shall, in conjunction with the Township Treasurer as soon as possible after the close of the fiscal year, provide a complete report on the finances and administrative activities of the Township for the preceding year.
(7) 
He/she shall hold such other municipal offices and head such municipal departments or initiatives as the Board may from time to time direct.
(8) 
He/she shall attend all meetings of the Board and its commissions and participate in such meetings as may be required in furtherance of his/her duties. He/she shall receive notice of all special meetings of the Board and its commissions.
(9) 
He/she shall, in conjunction with the Township Secretary, prepare the agenda for each meeting of the Board and supply facts pertinent thereto.
(10) 
He/she shall keep the Board informed as to the conduct of Township affairs; submit in conjunction with the Township Treasurer periodic reports on the condition of the Township finances, and such other reports as the Board requests; and make recommendations to the Board as he/she deems advisable.
(11) 
He/she shall initiate such action as may be required with respect to the enforcement of all ordinances, franchises, leases, permits and contracts by the Township.
(12) 
He/she may employ, subject to the approval of the Board, experts and consultants to perform work, and to advise in connection with any of the functions of the Township.
(13) 
He/she shall attend to the letting of contracts in due form of law, and supervise the performance and faithful execution of the same except insofar as such duties are expressly imposed by statute upon some other Township officer.
(14) 
He/she shall see, in conjunction with Township Treasurer, that all money owed the Township is promptly paid and that proper proceedings are taken for the security and collection of all Township claims.
(15) 
He/she shall be the Purchasing Officer of the Township and shall purchase, in accordance with policies and procedures set forth within the Township and compliant with the Second Class Township Code[1] and concurrence of the Board, all supplies and equipment for the departments under his/her supervision, and for other departments, offices, agencies, boards and commissions as the Board may from time to time direct.

(16) 
All complaints regarding Township services shall be referred to the Office of the Manager, with copies to the Board. He/she, or an officer designated by him/her, shall investigate and undertake to resolve such complaints and report to the Board with respect thereto.
(17) 
He/she shall analyze, with the assistance of other Township Officers as he/she may require, and report and recommend to the Board the facts or actions as may be pertinent or required.
(18) 
He/she shall undertake to maintain good public relations for all elements of the Township government, including periodic reports and such other information as he may be directed to prepare from time to time by the Board.
(19) 
He/she shall be responsible for overseeing the operation of the Police Department.
(20) 
He/she shall possess any other nonlegislative power or duty of the Board of Supervisors that the Board expressly delegates to the Township Manager by ordinance, resolution or motion, directive or policy in accordance with 53 P.S. § 66301(b).
If the Manager is unavailable or unable to perform the duties delegated hereunder, he/she shall designate one qualified member of his staff to perform the duties of the Manager in his/her absence or disability. The person so designated shall not perform said duties for a period longer than two weeks without approval of the Board.
All powers, duties or responsibilities delegated to the Township Manager by this chapter shall be subject to recall by action of the Board at any time without the necessity of amending or revoking all or any portion of this chapter.
