This chapter is enacted to provide for the uniform and equitable distribution
of the tax levies within the Township of West Brandywine, and to promote the
health, safety, and general welfare of the residents of the Township.
It is hereby enacted and ordained by the Board of Supervisors, West
Brandywine Township, that each and every owner (or owners) of any and all
apartment buildings, single-family residential unit, mobile home parks, or
of any and all other rental or leased properties situated within the Township
is required to submit an occupancy report provided by the Township, listing the number of parcels or units, including locations then
being rented or leased, or available for rental or lease, the name or names
and mailing addresses and employer's name of all renters or lessees over
the age of 18 occupying said rental units or parcels.
The property owner or owners are required to submit the occupancy report
to the Township Manager or his/her designee within 45 days from the effective
date of this chapter and to continue thereafter filing the occupancy reports
as follows:
A. On or before January 15th of each and every year; and
B. Within 30 days after a renter or lessee has left the
premises; and
C. On a quarterly basis by April 15, July 15, October 15.

Any owner (or owners) (which shall include and individual, partnership,
association, or corporation) who shall fail to comply with any provisions
of this chapter shall, upon conviction in a summary proceeding brought before
a District Justice under the Pennsylvania Rules of Criminal Procedure, be
guilty of a summary offense and punishable by a fine of not more than $1,000,
plus costs of prosecution. In default of payment thereof, the defendant may
be sentenced to imprisonment for a term not exceeding 90 days. It shall be

Any violations of the provisions herein shall be enforced by the Township
Manager bringing actions against the violators before a District Justice under
the summary actions provided for by law.
