Any employee who shall consider himself aggrieved in any matter
concerning his employment, excepting any matter concerning his rate
of compensation, retirement benefits, disciplinary proceeding or any
matter which is otherwise reviewable pursuant to law or any rule or
regulation having the force and effect of law, shall be entitled to
the following consideration of his grievance.
A. Presentation to department head. He may present his grievance orally
or in writing, if such employee so elects, to the head of the department
of the city government of the City of North Tonawanda in which he
is employed. If such grievance is not satisfactorily resolved on such
hearing, such employee may proceed to the second stage.
B. Presentation to committee.
(1) The employee may appeal to the committee of three members of the
Common Council having jurisdiction of such employee's department.
Each of the three-man committees hereby is designated as a grievance
committee for employees of their respective departments. Such employee
shall be granted a hearing before such committee and he shall have
the right to be represented by legal counsel on such hearing.
(2) The committee shall make a written report of its findings and decision
and a copy thereof shall be sent to the employee involved, his representative,
the head of the department and the Mayor.
(3) All hearings held under § 1B shall be promptly scheduled
after presentation of such grievance to the committee; provided, however,
that the employee involved may request, and if so requests, shall
be granted, an adjournment of not more than one week to prepare for
presentation of his grievance to the committee.
