No person, firm or corporation shall grade, construct, install or erect a drain, culvert, footwalk, drive or driveway or other means of ingress affecting discharge or passage of drainage water onto or along a Township road unless and until the Township has granted a permit for such grading, construction, installation or erection.
A. 
Application for such permit shall be made by the owner or occupier, or by his contractor or agent, in writing, on forms provided by the Township and in accordance with such rules and regulations as may be established by the Township. There shall be appended to each application a drawing or plan showing the outlines of the property affected with existing improvements thereon, existing drains, culverts, footwalks, drives and driveways, with the proposed drain, culvert, footwalk, drive or driveway proposed to be added and the relationship of the foregoing to the Township road, particularly with relationship to the effect on the drainage of said road.
B. 
Any design submitted hereunder shall provide as follows:
(1) 
A depressed swale shall be installed in the driveway adjacent to the roadway to prevent the flow of water onto the Township road.
(2) 
Where necessary, a drain pipe shall be installed where needed to provide that the water shall flow across or away from the driveway, as needed.
(3) 
That the driveway shall be graded with a crown so as to flow water into any drain to carry water away from the driveway and off the roadway.
(4) 
Where deemed necessary by the permit office, a dry wall shall be installed to prevent water from flowing into the roadway or onto adjacent properties from the said driveway.
(5) 
Any pipe installed shall be at least a diameter of eight inches or such larger diameter as may be needed or required by the Township permit office.
(6) 
Such driveway configuration shall be maintained by the owner of the property and shall not be modified without submitting an amended permit application hereunder.
C. 
Driveway permit.

(1) 
Where any driveway or access drive is to be altered or modified relative to its dimensions, elevation, or slope, a driveway application for that use must be issued by the Building/Zoning Permit Officer. Said permit application shall include a scaled drawing showing the present location of the driveway or access road and the proposed alterations thereto.
(2) 
No permit shall be required by any individual or entity that intends to seal or reseal any driveway or access road unless said sealant will serve to alter the dimensions, elevation, or slope of the driveway or access road.
A. 
The costs of filing such application and permit to be issued thereon, and the cost of any inspection deemed necessary by the Supervisors, shall be determined according to a schedule of fees which will be adopted by the Supervisors by resolution, and all such fees and costs shall be paid into the Township Treasury.
B. 
The fee for the issuance of a driveway permit on a Township road shall be $25.
The Supervisors or their designers may alter plans with applications and specify any changes or modifications of any kind which they may deem necessary and make their approval of the granting of any permits subject to any such alterations, changes or modifications.
All grading, construction, installation and erection shall be in strict compliance with the plans and specifications on the basis of which the permit is granted. All designers shall comply with all Township ordinances.
Any person, firm or corporation violating the terms of this article or of any of the terms and conditions of any permit issued hereto, including any regulations applicable thereto, shall, upon conviction thereof before a Justice of the Peace or Magisterial District Judge, be sentenced to pay a civil penalty of not less than $25 nor more than $100, together with costs of the action.
